The Superior Court has ruled that the medical report in the case of rape is not the main one, but the oral and circumstantial testimony of the victim accredits the allegations against the accused but the accused can be convicted based on it.
Ibrahim Gazi, who was sentenced to life in prison in a rape case at the Khulna Abuse of Women and Children Abuse Court, was confirmed on Wednesday (October 14). The high court headed by Rezaul Haque and Judge Bishmadev Chakraborty delivered the verdict.
Previously, Ibrahim Gazi was sentenced to life imprisonment by the Khulna Women’s and Child Abuse Suppression Court for not having a medical report on the victim.
The court ruled that the rape case would not be considered unproven just because it did not have a medical report. Even if the allegations made against the defendant are proven by the oral and circumstantial testimony of the victim, the defendant can be convicted on that basis. Therefore, the excuse that the accused did not commit a violation due to lack of a medical report is not acceptable.
The Superior Court also observed that the victim presented a late case but it was not a lie.
