A landmark verdict in the Dhaka Metropolitan Sessions Court of Judges on Wednesday proved the murder of a young man named Johnny in police custody. This is the first death sentence in police custody in the history of Bangladesh. Six years after the incident, the court yesterday convicted three defendants in the case, the then Deputy Inspector (SI) of the Pallabi Police Station Zahidur Rahman Zahid, Deputy Deputy Inspector (ASI) Rashedul Islam and ASI Kamruzzaman Mintu (two now IS promoted) to life imprisonment. At the same time, the court ordered a fine of one lakh of rupees and a prison sentence of six months for non-payment. Each of the three policemen has also been ordered to pay a compensation of 2 rupees to the plaintiff.

The other two defendants in the case, law enforcement sources Russell and Sumon, have been sentenced to seven years in prison and fined Taka 20,000 and three months in prison for non-payment. The verdict was announced by Dhaka Metropolitan Sessions Judge KM Imrul Kayes. Although there were many reports of death in police custody in the country, the first verdict was in the case of Johnny’s murder through the case and trial.

Before the verdict, SI Zahidur Rahman Zahid and the Sumon police source, who were in jail at 1:55 pm, appeared in court. SI Rashedul Islam from the same police station also appeared and was out on bail. The court ordered that they be sent to jail with a sentencing order. Fugitive SI Kamruzzaman Mintu and police source Russell did not appear in court on bail. The court issued sentencing orders against the two.

Ishtiaq Hossain Johnny and his brother Imtiaz Hossain Rocky were taken to the Pallabi police station and beaten during the night of February 8, 2014 for protesting the indecent behavior of a police source in a yellow ceremony at a friend in the Mirpur-11 sector . When Johnny’s condition worsened, Chiki Tsak on duty declared him dead after taking him to Dhaka Medical College. Johnny’s relatives have been awaiting trial for six years after he filed a case under the Prevention of Death in Police Custody Act. They are victims of harassment. Family members also demonstrated in front of the court yesterday in the hope of justice. In the end, they expressed satisfaction after hearing the verdict. Johnny’s two sons also came to court hand in hand with their mother to obtain justice for their father’s murder. The prosecution expressed its satisfaction with the landmark verdict, but said the defendants would appeal to the higher court.

Description of the brutal murder in court: The judge began reading the verdict at 2 pm. Before announcing the verdict, the judge said that the torture he was subjected to in police custody was heinous and a violation of human rights. Death in police custody is the worst crime. During the verdict, it was said that at a stage of torture in the custody of the Pallabi Police Station, Johnny kept asking for water to eat. But at that moment it was spit out instead of water. Therefore, the three convicted in this case were given the maximum sentence of life imprisonment under this law.

Satisfaction with the verdict: Abdullah Abu, the state attorney for the Dhaka Metropolitan Court, said: “The verdict has given the maximum punishment to the defendants. The state is satisfied with this. Through this verdict it was understood that no one is above the law. If you commit a crime, you will be punished. ‘ The defendant’s lawyer, Farooq Ahmed, said: “I will appeal this verdict in the higher court.”

How the historic verdict came: According to court and case documents, Dhaka Metropolitan Sessions Judge KM Imrul Kayesh set the verdict date as August 24 after presenting the defendants’ arguments. A total of 24 witnesses testified in the case. On February 8, 2014, during a yellow ceremony on the son of a local man named Sadeq in Mirpur-11 sector, a Sumon police source misbehaved with the girls. At that point, Johnny and his brother Rocky told Sumon to leave. Sumon left, but arrived the next day and continued to behave as before. When Johnny and his brother told him to leave, Sumon called the police. Later the police arrived, arrested the two brothers and took them to the police station. Police opened fire when locals drove them away. Later, Johnny was taken to the police station and tortured. At one point, Johnny became physically ill and was admitted to the National Hospital. Later, when his condition deteriorated, he was taken to Dhaka Medical College Hospital, where Chiki Tsak was pronounced dead.

Following the incident, on August 8 of that year, Johnny’s younger brother, Rocky, brought a case against eight individuals, including the Pallabi Police Station OC Ziaur Rahman, under the Torture and Death in Police Custody Act. at the Dhaka Metropolitan Sessions Court of Justice. The court ordered a judicial investigation into the accusations. On February 17, 2015, Dhaka Metropolitan Magistrate Maruf Hossain presented an investigative report recommending the release of five defendants and five others. During the investigation, ASI Rashedul and Kamruzzaman Mintu were once again included in the case. On April 17, 2016, the Dhaka Metropolitan Sessions Judge, Kamrul Hossain Mollah, ordered the prosecution of the defendants to be opened by filing charges against the Pallabi Police Station SI Zahid, ASI Rashedul, ASI Kamruzzaman Mintu, Source Sumon and Rashed. The trial of the case ended approximately four and a half years after the charges were filed.

By the way, in 2013 the “Law on Prevention of Torture and Death in Police Custody” was enacted. Since then, the police have been trying to repeal and amend the law. There have been several cases.
