The necessary amendments have been requested to article 375 of the Penal Code and article 9 of the Law on the prevention of violence against women and children.
At the same time, the notice has requested that the necessary teaching measures be taken by appointing the necessary teachers at Alia Madrasa and Qaumi Madrasa.
Attorneys Mohammad Humayun Kabir Pallab and Mohammad Kawshar sent the notice on Thursday on behalf of a human rights group called Law and Life.
The notice was sent by post and email to the offices of the Secretary of the Home Office, the Secretary for Legal and Parliamentary Affairs, the Secretary of Education, the Secretary for Religious Affairs, the President of the Board of Education of Alia Madrasa and the Chairman of the Board of Education of Qaumi Madrasa.
Academics are also ‘concerned’ about sexual harassment in madrassas
When asked about the notice, lawyer Humayun Kabir Pallab told bdnews24.com: “There is a provision in the penal code for rape, which again is in conflict with other laws. Article 37 of the Penal Code calls it (violation ) an “unnatural crime.” Seen as other unusual crimes.
“Although there is a provision for life imprisonment, it is not considered rape. But it is a total violation. In many parts of the world, including the UK, it is considered rape.
“However, in our country, rapes occur constantly in various educational institutions, especially in madrasas. This has been happening a lot in recent times. But there is no cure. Criminals are taking advantage of that opportunity.”
The lawyer said: “Under existing law, the maximum punishment for rape is death. But rape is not treated as rape. As a result, the rape must be treated as rape and the perpetrators must be punished. ”
You have been asked to take action on this within 5 days of receiving the notification. Otherwise, legal action will be taken, the attorney said.
Netishe said: “The number of Alia Madrasa and Qawmi Madrasa in the country is more than one lakh. Approximately a crore of students study in these madrasas with only male teachers. But these madrasas lack administrative transparency and accountability. That is why tender-hearted students are often victims of sexual harassment, including rape. Many students are dying as a result of these sexual abuse and rapes. ”
Noting that these incidents have increased at an alarming rate in recent times, the notice read: “Rape is not considered rape under existing Bangladeshi law. As a result, men, including madrasa teachers, are seizing this opportunity. ”
Article 37 of the Penal Code establishes that if a person intentionally has sexual relations with a man, a woman or an animal against natural law, they will be punished with life imprisonment or imprisonment for any term (up to ten years) and also with a fine. .
