The trial will continue after the case has been transferred to the previous court.

He said the Secretary General of the Supreme Court was ordered to inform all the Courts of District and Session Judges on the instructions of the court.

Humayun said the dishonor or check fraud case is judged by the District Judge and Additional Sessions and the Joint District and Session Judges Court. The court was determined by the Court of District and Sessions Judges. Once again, the judgment or order of the Joint District Court of Judges was appealed to the District and Sessions Court.

He said the appeal against the order and verdict from the Additional District and Sessions Court or the District and Sessions Court was in the last Superior Court. This provision is in conflict with Articles 26 and 31 of the Constitution of Bangladesh. This has led to judicial chaos.

“According to the ruling, only a joint session judge can judge the case of a check designer. Session judges or additional sessions judges cannot judge verification cases.”

Islami Bank has filed three cases against AM Ziaur Rahman alleging check dishonor. The cases are pending in the Joint Court of District and Sessions Judges in Chapainawabganj.

He filed a separate writ petition on October 16, 2016 challenging the procedures in the three cases. The Superior Court then issued a brief on the preliminary hearing.

The rule seeks to find out why the judicial process of the Joint District Judges Court should not be declared invalid in handling a check dishonor case.

The Superior Court rendered its verdict after disposing of that rule.
