‘Johnny spits in his mouth if he wants water’

Dhaka: In the custody of the Pallabi Police Station in the capital, Ishtiaq Hossain Johnny was tortured and at one point kept asking for water to drink. But then they spit on him instead of water. Such a thing has come up in the court’s verdict.

The court said that the torture he was subjected to in police custody was heinous and a violation of human rights. Although SI Zahid saw the other two policemen during the torture, they did not help the victim but rather assisted in the crime.

Therefore, the three defendants in this case, the then Deputy Inspector (SI) of the Pallabi Police Station Zahidur Rahman Zahid, ASI Rashedul, ASI Kamruzzaman Mintu, received the maximum sentence of life imprisonment under this law.

Furthermore, each of the accused was sentenced to six months in prison for failing to pay a fine of one lakh rupees. Each of the three defendants will have to pay two lakh rupees to the family of the victim. The court also ruled that the money must be paid and appealed within the next 14 days.

Police sources Sumon and Rashed were sentenced to seven years in prison in the case. Each of them has been sentenced to three months in prison for failing to pay a fine of Taka 20,000.

Dhaka Metropolitan Sessions Judge KM Imrul Kayesh rendered the verdict on Wednesday (September 9).

For several years, the police had been demanding the repeal of the Prevention of Torture Deaths and Custody Act of 2013. Meanwhile, seven years after the law was passed, the first verdict will be delivered on Wednesday.

After presenting the arguments of the state and the defendants in the case, Dhaka Metropolitan Sessions Judge KM Imrul Kayesh set the date for the verdict at August 24.

On February 9, the defendants in the case defended themselves. Subsequently, the argument of this case began to be presented on February 19. Due to the Corona situation, the discussion stopped in the middle. When the regular court proceedings began in August, the arguments in the case ended on August 24.

According to the file, on February 8, 2014, during a local wedding ceremony in Mirpur Sector 11, a Sumon police source treated the girls indecently. At that point, when Johnny and his brother Sumon were asked to leave, he called the police. The police came and arrested Johnny. When the locals chased the police, they opened fire.

Johnny’s condition deteriorated into a stage of torture in police custody after he was taken into custody. At that time he was taken first to the National Hospital and then to the Dhaka Medical College Hospital, where the doctor on duty pronounced Johnny dead.

Imtiaz Hossain Rocky, younger brother of the deceased, brought a case against eight individuals, including the Officer-in-Charge (CO) of the Pallabi Police Station, Ziaur Rahman, under the Torture and Death in Police Custody Act in Court of Dhaka Metropolitan Sessions Judges on August 8, 2014. The court ordered a judicial investigation into the allegations.

On February 17, 2015, Dhaka Metropolitan Magistrate Maruf Hossain filed a report charging five people, including three police officers. Although five people, including OC Ziaur Rahman, were acquitted, ASI Rashedul and Kamruzzaman Mintu were again charged in the report.

On April 17, 2016, the judge of the Dhaka Metropolitan Session, Kamrul Hossain Mollah, ordered the trial of the defendants to begin. The trial of the case ended approximately four and a half years after the charges were filed.
