BRAC Bank ordered to pay compensation of 15 lakh Tk to Jahalam

The court ordered BRAC Bank to pay Tk 15 lakh to Jahalam, an innocent jute factory worker, within one month.

A higher court of Judge FR Nazmul Ahsan and Judge KM Kamrul Quader approved the order on Wednesday. ACC lawyer Khurshid Alam Khan confirmed the matter to Jugantar. In addition, the ACC has been warned about the Jahalam incident.

Early Tuesday, the matter was on the verdict agenda. After the court proceedings began that day, Judge FR Nazmul Ahsan wanted to know why the real defendant Abu Salek was out of reach for so long. The ACC lawyer later said, “I hope they catch him.” I heard you went to India. However, there are reports at the border. It has also been reported in India. There has been a delay due to Kovid. I hope you find it useful.

The judge also wanted to know why the ACC’s action against the investigators in the case had not ended.

In response, the ACC’s lawyer said it was due to the cowardly situation. But towards the end of all procedures. Khurshid Alam Khan told the court that such an incident had never occurred before in the history of the ACC. I hope this does not happen again in the future. In this case we had no bad intentions. Above all, we will get the verdict of the court.

Then the judge said that if Jahlam’s imprisonment was also called false imprisonment, then he had been deprived of his liberty. So tell me if the ignorant can get compensation in this case.

In response, Khurshid Alam said: “Yes, Jahalam is entitled to compensation.” But that compensation will not be for us (ACC). That will be for the bank. Because the ACC has carried out the investigation process based on the documents provided by the bank. So the bank has to take responsibility.

The judge also asked Sonali Bank’s lawyer if Jahalam could obtain compensation. Sonali Bank’s lawyer, Zakir Hossain, said that ACC’s lawyer’s statement was “misleading.”

The ACC once said that Jahalam can get compensation, but again said that it is not the ACC’s responsibility, the ACC will not pay compensation. Talk about the bank again. But the bank did not mention Jahalam’s name anywhere. The ACC has added Jahlam’s name with ‘aliases’ after Abu Saleh.

The ACC attorney later said: “I did not present anything confusing in my statement.” I have presented our argument to the court. Addressing Sonali Bank’s attorney at this stage, the higher judge said, then why did Sonali Bank take action against its officials? Then, lawyer Zakir Hossain said, the bank has taken action due to its negligence in the banking field.

The bank has no responsibility on the issue of ignorance here. So the compensation does not fall to Sonali Bank. But I think Jahlam deserves compensation. FRM Judge Nazmul Ahsan then said, “Okay, I heard your statement.” The verdict will be announced tomorrow at 2:00 p.m.

The ACC has brought 33 cases against a man named Abu Salek for allegedly embezzling around 16 million rupees of Tk from Sonali Bank. But investigating officers forgot that instead of Salek, Jahlam of Tangail had to spend three years in jail.

A national newspaper published a report entitled “Sir, I am ignorant, not Salek.” Lawyer Amit Dasgupta brought this to the attention of the High Court of Judges FRM Nazmul Ahsan and Judge Kamrul Quader.
