About a decade and a half ago, Sumna Sarkar, who passed the BCS (Health) Preliminary and Written Exams to pass the Muktijoddha quota, was asked by the Appeals Division to take the Viva (oral) exam.
The Public Service Commission (PSC) has been asked to implement the order. A bench of three judges from the Appeals Division headed by Chief Justice Syed Mahmud Hossain approved the order on Thursday.
Motahar Hossain Saju and Selina Akter Chowdhury, attorneys for Sumna Sarkar and Shamim Khaled of PSC appeared in court.
Motahar Hossain Saju said that after resolving the request, the Appeals Division asked the PSC to take Sumna Sarkar’s living test. Dr. Sumna currently works in a private hospital in Chittagong.
The lawyers said that in 2003, Sumna Sarkar passed the 23rd BCS (health) preliminary written exam. But his card was not issued in the live exam as he was unable to show his original certificate. There were 292 more like this. 12 of them filed a petition for appeal before the Superior Court.
After the hearing on the writ of writ, the Superior Court ordered the PSC to conduct its live examination. Later they are recruited. Following this incident, Sumna Sarkar submitted an application to PSC along with a certificate of parole to take Viva. The PSC filed a judicial petition in Superior Court in 2009 for not giving it a chance.
After a lengthy hearing of that car, the Superior Court in 2015 ordered to take the living test. The PSC appealed against the verdict. The court judge suspended the judgment of the Superior Court. The Appeals Division held a hearing on that request. At the end of the hearing, the transparent court ordered the PSC to submit to the vivai test.
The lawyers said that if the order is received, it will be known within how many days the PSC will have to take the living test.
