The main defendant in the murder case of Raihan Ahmed, who was tortured at a police post in Sylhet, has announced that he will not fight for the expelled SI Akbar. Misbauer Rahman Alam. He surrendered his power of attorney on Thursday (December 24) and filed a petition in court. Misbauer Rahman said he was forced to make the decision due to criticism from his lead attorney.
Previously, the Sylhet District Bar Association had said that no lawyer for Sylhet would appear in court on Akbar’s behalf. The leaders of the association also said this while visiting Raihan’s home.
On Friday (December 25), the lawyer confirmed to the Bengali Tribune. Misbauer Rahman Alam. He said: ‘I have handled many cases, including murders and kidnappings of the legal profession. The Raihan murder case was a similar case to mine. Not accepting more money, but accepting the case on Raihan’s behalf out of a sense of professional responsibility when he is contacted to handle his case. The case of the Prevention of Deaths in Custody Act was of a completely new kind and a challenge for me. So I accepted the case without thinking about anything and also filed a power of attorney in court on behalf of Akbar.
“Access to legal services is a basic human right,” he said. No accused can be convicted without the possibility of defending himself. Furthermore, this case is a maximum penalty case. If the defendant is unable to appoint an attorney in such cases, the state is obligated to appoint an attorney on their behalf. If for some reason the defendant does not get a lawyer, the entire judicial process will get bogged down. The judicial candidates will be the losers. From this point of view, I agree to appoint a lawyer for Akbar.
The lawyer added: “But I refrained from fighting for Akbar, as many people made negative comments about my respected superior.” I have delivered the power of attorney submitted on behalf of Akbar on December 24 and have also filed an application in this regard in court. If Akbar does not get a lawyer, the case will not be tried, it will not be happy for Raihan’s family, and it will also be an obstacle to the establishment of the rule of law.
Raihan Ahmed, 34, a resident of the Akhalia area of the city, died on the morning of October 11. He was reportedly tortured to death at the Bandarbazar outpost. Later that night, Raihan’s wife, Tamanna Akhter, filed a case under the custodial death law. Later, a team from the Metropolitan Police investigated and found the truth of the torture. Four people, including SI Akbar Hossain Bhuiyan in charge of the city’s Bandar Bazar outpost, were suspended on October 12 and five were removed. On October 13, SI Akbar escaped from police custody. Police arrested him on November 9 at the Dona border in Kanaighat in Sylhet.
