‘Serious fault’ of the EC, letter from 42 citizens to the president

The letter was sent to the president on December 14, reported in a virtual press conference on Saturday.

The letter was sent on behalf of 42 citizens by Supreme Court attorney Shahdin Malik, who was a former EC attorney.

Signatories to the letter include Professor Sirajul Islam Chowdhury, retired Secretary Akbar Ali Khan, who has served as an advisor to several interim governments, retired Auditor General M Hafizuddin Khan, human rights activist Sultana Kamal and educator Rasheda K Chowdhury.

In the letter, a request has been made to form a Supreme Judicial Council pursuant to Article 96 of the Constitution of Bangladesh to investigate the charges against this constitutional body.

Speaking at the press conference, Shahdin Malik said: “We all feel that the activities of the Electoral Commission after taking office are a serious fault. The Supreme Judicial Council has the power to investigate those who hold constitutional positions. Neither the ACC nor the police can do that. The president can give instructions. In this context, I have complained to the president.

“The Supreme Judicial Council should be formed to investigate. We hope that they will be found guilty of serious misconduct. The president will remove them as recommended by the Supreme Judicial Council.”

TIB Executive Director Iftekharuzzaman told a press conference: “Never before has the current Election Commission been involved in financial irregularities. He broke all previous records. The name of the Electoral Commission has been insulted and tarnished.

“I have appealed to the president and at the same time I will go to the head of government. I will also appeal to the Honorable Prime Minister. Until a decision is made, the CEC and commissioners may resign voluntarily and some may resign voluntarily. We hope so. “

“Article 48 (5) of the constitution states that the president can present the cabinet for discussion through the prime minister,” Malik said.

At the press conference, Shahdin Malik said: “The electoral system in the country has collapsed. Selection is the game of selection. The president will do everything possible to restore democracy as the guardian of the country. That’s why we gave him the letter.

When asked if the expectation that the president would remove the election commissioners was realistic, he said: “There have been some bad elections in the past. The February 15, 1996 election was probably the worst. That is what is happening. Now, that choice is not desirable.

“We believe there is a deep crisis. In times of deep crisis, the nation looks to His Excellency the President. He has moral power. We are definitely optimistic. We hope that the President will respond positively to this accusation.”

When asked why the accusation was made three years later, Shahdin Malik said: “Our accusation is very serious. These have happened in stages. We did not want to do it with 2-3 complaints. I waited, I saw, I watched.

“I have collected complaints about them in magazines. Serious misconduct, corruption has been enough. The moral position to stay here is no longer (your). The scale of the complaint has been very large. At this stage, I had been preparing for several months. “

Sujan’s secretary, Badiul Alam Majumder, said: “The Election Commission has betrayed the blood of freedom fighters. He has betrayed Bangabandhu. It would be better for them to stay away now. “

Former Secretary Abdul Latif Mandal, who was once a secretary in the President’s Office, expressed doubts about whether anything would happen if he appealed to the president.

“The president is expected to send it to the prime minister,” he said. But there are doubts about whether to send. It can be sent to the Prime Minister separately. ”

Professor Asif Nazrul said: “I know that ultimately nothing will happen. But I urged it. It’s in the constitution. “

He asked journalists to ‘follow up’ on the matter.
