The Superior Court acquitted five convicts who were sentenced to death for gang-raping a teenage girl a decade and a half ago.
The high magistrate court SM Emdadul Haque and the magistrate Bhishmadev Chakraborty handed down the verdict on the transfer of death (application for sanction of the death penalty) and the hearing of the defendant’s appeal and the appeal to prison on Monday.
Attorneys for the defendants said the state court could not prove the charges against the convicts beyond a reasonable doubt.
Deputy Attorney General Mozammel Haque Rana Siddiqui represented the state in court. Attorneys AKM Fazlul Haque Khan Farid, AM Mahbub Uddin, Bazlul Kabir, Afil Uddin, Shakib Mahbub, Saifur Rahman Rahi and state appointed attorney SM Shafiqul Islam represented the defendants.
The defendant’s attorney, Fazlul Haque Farid, said the medical report indicated that there were no signs of rape in the case. Furthermore, the plaintiff’s statement was inconsistent with the plaintiff’s statement. As a result, the rape allegation is not out of question.
Deputy Attorney General Mozammel Haque, who is handling the case on behalf of the state, blamed the witnesses’ conduct for the lack of proof of the allegations.
When asked if the state would appeal against the verdict, he said he would send a note to the attorney general. He will appeal if he decides.
On February 25, 2015, 13 years after the incident, the Netrokona Abuse of Women and Children Suppression Court sentenced five of the six defendants in the case to death.
According to the statement in the case, on July 20, 2002, the girl was on her way to a relative’s home in the Bahadurpur village of the Netrokona Sadar Police Station when she reached the Hogla asphalt road bridge in the area of Kumarkhali at night. She was raped. She was later taken to a nearby building and raped again.
Meanwhile, when the police arrived after receiving the news, the defendant went down to the water of the bill with the girl, it has been said in the case. Later, he left the girl and fled.
The next day, the girl filed a case at the Purbadhala Police Station. I was 15 then.
Four months after the incident, the police filed a charge sheet on November 8 of that year. Ten years later, on October 9, 2012, charges were brought against six defendants in court. Three years later, on February 25, 2015, five defendants were sentenced to death and one was acquitted.
