The High Court has rejected a judicial petition requesting the closure of the Mayisha group and the Arisha economic zone owned by parliamentarian Aslamul Haque and compensation.

Justice Md. A bench of the High Court of Judge Ashfaqul Islam and Judge Mohammad Ali on Wednesday dismissed the appeal petition filed by Aslamul Haque. Lawyer Aji Ullah and Lawyer Mamun Mahbub appeared for Aslam and Lawyer Manzil Morshed appeared for the river commission.

Manzil Morshed said: “The court has rejected the writ of writ filed by MP Aslam seeking to stop the eviction. As a result, there were no obstacles to eviction in their occupied part.

On March 3, BIWTA demolished several structures, including the Mayisha power station boundary wall, as part of a campaign to liberate Buriganga. Approximately four acres of land were recovered. Next to this plant is the Arisha Private Economic Zone.

Aslamul Haque presented three appeals to the Superior Court against the BIWTA operation. After a hearing, the court ordered the National River Protection Commission to conduct a study and report on the land in dispute.

The hearing was held on September 18 in the conference room of the River Protection Commission in the presence of all interested parties. Additionally, eight government agencies such as the District Administration, BIWTA, the Bangladesh Space Research and Remote Sensing Organization (SPARSO) carried out the survey in the disputed areas.

On the basis of all this, the final report produced by the River Protection Commission said that clear evidence has been found against MP Aslam for occupying the river land.

According to the report, the Mayisha Group and Arisha Economic Zone’s activities in changing the terrain class of the floodplain constitute a clear violation of Section 5 of the Natural Resources Act of 2000. If the economic zone is fully implemented, the effects The adverse effects on the biodiversity of Buriganga and Turag will be more pronounced. Therefore, in order to protect Buriganga and Turag, the activities of the Arisha Private Economic Zone and the Mayisha Power Plant must be stopped immediately.

The commission said the location of the Arisha Private Economic Zone and the Mayisha Power Plant on the 54,017-acre floodplain of the Buriganga River was “proven fact” and “unacceptable.” An area of ​​14 km of the river has died due to the occupation of Aslam.

The commission also said that the authorization granted to the Arisha Private Economic Zone and the Mayisha Power Plant by the Environment Department was illegal. According to the report, for the execution of these two projects, the authorization certificate from the Department of the Environment has been renewed. Knowing the land of the river, it was not reasonable to give location, EIA, environmental authorization.

The report recommended that BIWTA and the district administration take steps to expedite the eviction. If MP Aslam does not remove the illegal facility on his own initiative, he will have to pay the full cost of the eviction, according to the report.
