Life imprisonment means 30 years in rigorous prison. However, in any case, the country’s court or tribunal is empowered to sentence the accused to death. And if a convict is sentenced to death as a result of the exercise of that jurisdiction, he will have to spend the rest of his life in prison until natural death. That is imprisonment to death. The Appeals Chamber of the Supreme Court has ruled that he will not obtain any concessions.
A bench of seven judges from the Appeals Division headed by Chief Justice Syed Mahmud Hossain delivered the verdict on Tuesday based on the majority of votes. The verdict ends the past three years of confusion over the term of life in prison, legal experts say. They say this verdict is a milestone. The verdict added a new dimension to the history of the criminal justice system.
In 2003, a lower court sentenced Ataur Mridha and Anwar to death for killing a man named Zaman in Savar. On October 30, 2008, the Superior Court confirmed the death penalty for the two defendants. The defendant appealed against the verdict. On February 14, 2016, the Appeals Division headed by former Chief Justice SK Sinha commuted the death sentence and sentenced the two men to life imprisonment.
At the same time, the Supreme Court ruled that life imprisonment means death. The accused will remain in prison until his natural death. Ataur and Anwar filed a petition for review to reconsider the verdict. শুন The hearing on the petition for review is scheduled to be announced on Tuesday.
The verdict reads:
Following the start of the Appeals Division proceedings in the morning, the Chief Justice delivered the verdict on the petition for review. He said the verdict was based on the opinion of the majority of the court judges.
The verdict said that initially life imprisonment means imprisonment until the death of the convicted person. However, if articles 45 (life imprisonment) and 53 (penalties) of the Penal Code are combined with articles 55 (reduction of life imprisonment) and article 57 (fraction of the prison sentence) of the same law and 35 (a) of the Code of Criminal Procedure (CRPC), then life imprisonment. That means 30 years.
Furthermore, when a tribunal, tribunal or tribunal constituted within the framework of the International Criminal Tribunal for the former Yugoslavia (ICT) is sentenced to death, the sentenced person will not obtain the benefit (discount) of article 35 a) of the Code of Criminal Procedure.
