Feni: Nusrat Jahan Rafi. Sonagazi is a student at Islamia Senior Fazil Madrasa in Feni.
The most talked about incident of the past year was the murder of this teenager. On October 24 of that year, 18 people were hanged in the case. Today 1 year has passed but the verdict has not been effective.
Police are still on duty at Nusrat’s home in the Sonagazi Charchandia area. The family suffers from insecurity because the verdict is not effective. Family members say the verdict has not been effective even after a long year.
On October 24 of last year, the Judge of Feni Judge of the Court for the Repression of the Abuse of Women and Children. Mamunur Rashid sentenced 17 defendants to death in the widely discussed case and fined them Tk 1 lakh. Subsequently, four sentenced to death in the case appealed to the higher court for acquittal.
Siraj’s supporters tried to kill Nusrat by placing him on the roof of the test center on April 6 last year, pouring kerosene on him, and setting him on fire, as he did not withdraw the charge of indecency against the madrassa director in 2019. On 75 per one hundred of his body was burned. He later died at Dhaka Medical College Hospital on the night of April 9 while in treatment. After the death, the incident crossed the borders of the country and caused a storm of criticism in the international media. The protesters took to the streets demanding a speedy and exemplary trial of those involved in the incident. Nusrat’s brother, Mahmudul Hasan, filed a case with the Sonagazi Model Police Station.
On the other hand, Barrister Chhayedul Haque Sumon filed another case under the ICT Law for calling him to the police station and recording the video of the interrogation. The court sentenced OC Moazzem to seven years in prison and fined him 10 lakh Tk. This is the verdict published by the first cyber court of Bangladesh.
When visiting Nusrat’s house in the Sonagazi Charchandia area, it is seen that there are still guards at the house. Now the life of the Nusrat family has not returned to normal. The pain of losing family members is still in her tears. Nusrat’s mother still can’t sleep at night thinking about her daughter. Brothers get wet when they think of their sister. The father cries out to Allah for his daughter.
Nusrat’s older brother, Mahmudul Hasan Noman, the plaintiff in the case, said: “We have justice in the court of law.” Nusrat’s soul will find peace through the swift execution of the verdict. This will be a signal for the criminals in ambush. It is unexpected that the sentence was not carried out even after a year of the verdict. He demanded the prompt execution of the sentence after hearing the appeal of the higher court urgently.
According to members of Nusrat’s family, the police and various sources, Nusrat Jahan Rafi was sexually harassed by Siraj-ud-Daulah, the director of Sonagazi Islamia Fazil Madrasa on 26, 2019. In that incident, his mother became the plaintiff and filed a case against Principal Siraj as the sole defendant. On the same day, the police arrested Siraj and sent him to jail through court.
The principal’s supporters and classmates pressured Nusrat and his family to withdraw the case. On April 3, 2019, the killers arrived at the jail in consultation with Siraj and planned to kill Nusrat on April 4 in the madrasa bedroom. When Nusrat Alim arrived to take the test on April 6, his colleagues took him to the roof of the cyclone shelter and tried to kill him by pouring kerosene oil on him. 75 percent of his body was burned.
Nusrat was rescued from the scene and taken to the Sonagazi Upazila Health Complex. Later, when the condition of Feni General Hospital deteriorated, Nusrat was admitted to the burn unit of Dhaka Medical College Hospital. Nusrat died on the night of April 9 while receiving treatment there.
Nusrat’s brother, Mahmudul Hasan Noman, filed a case with the Sonagazi Model Police Station on April 8. After conducting the necessary investigation into the case, the Police Investigations Directorate (PBI) issued indictments against 16 defendants. On June 20, the Court for the Repression of the Abuse of Women and Children was formed. Judge Mamunur Rashid sentenced all the defendants to death on October 24 after receiving testimony from six people in 61 working days. He also fined each defendant 100,000 rupees.
The prisoners are: Sonagazi Islamia Senior Fazil Madrasa, former director SM Siraj Ud-Daula (56), Nur Uddin (20), Shahadat Hossain Shamim (20), councilor and former general secretary of the Awami Municipal League of Sonagazi Maksud Alam (50 ), Saifur Rahman. Mohammad Jobayer (21), Jabed Hossain aka Sakhawat Hossain (19), Hafeez Abdul Quader (25), Abshar Uddin (33), Kamrun Nahar Moni (19), Umme Sultana Poppy (19), Abdur Rahim Sharif (20), Iftekhar Uddin Rana (22), Imran Hossain Mamun (22), then president of the Upazila Awami Sonagazi League and former vice president of the Ruhul Amin madrasa (55), Mohiuddin Shakil (20) and Mohammad Shamim (20). Following the lower court verdict, the main defendants, Director Siraj, Nur Uddin, Jabed Hossain and Umme Sultana, appealed to the higher court seeking the acquittal of Poppy. Now the appeal is pending hearing.
Nusrat’s lawyer, M. Shahjahan Saju, said that on October 29, 2019, all the proceedings of the case for the approval of the defendant’s death sentence (death reference) reached the High Court. According to the Code of Criminal Procedure, if a death sentence is passed in a judicial court, all the proceedings of the case must be sent to the higher court for approval. According to him, the reference to the death reached the High Court. Paper books (all case papers) were printed with priority.
The case was subsequently presented to the Chief Justice for hearing after the necessary work was completed. The Chief Justice has set up a bank to hear the appeal with priority. A bank headed by Judge Hasan Imam and Soumendra Sarkar is scheduled to hear the case. The case will be known as a priority once the corona virus crisis is resolved. Nusrat’s family wants the government to set an example by implementing the verdict as soon as possible.
