When the older gentlemen arrive, I will say that no one was taken to the outpost or tortured. He (Raihan) was caught hitting the people from the delivery house. They have taken him directly to Osmani Hospital, I’ll say what I say. If I’m telling the truth, I’ll shoot him in the chest, he’ll come out on his back. ‘
The two officers were thus threatened by SI Akbar Hossain Bhuiyan, the then manager of the Bandarbazar outpost in Sylhet and the main suspect in Raihan’s murder.
Saidur Rahman and Delwar Hossain, police officers working at the outpost, said this in their statement given to the court under section 164. Officer Shamim Mia has testified in the same court in the case of Raihan’s death due to to police torture at the Bandarbazar outpost. The three statements reached the hands of Jugantar.
It emerged that after the Police Investigation Bureau (PBI) assumed responsibility for investigating the case, three Delwar officers, Shamim and Saidur, who were in charge of the port outpost at the time of the incident, were taken away to the private chamber of the judge of the Jihadur Rahman Metropolitan Magistrates Court on October 19. The judge accepted his statement there.
Shamim: Sheriff Shamim Mia testified that he fell asleep in the Munshi ward of the outpost on October 10 around 2 p.m. after completing preparatory studies for the departmental promotion exam. After 3 in the afternoon, he woke up when he heard crying inside the room. You can see Raihan’s hands entwined behind his back. He’s sitting on the floor screaming.
Sheriff Titu Chandra Das hits him randomly with a thick stick. At one point, he leaned to the right and lay down on the ground, then Agent Titu struck him on the ground. Then, Agent Harunur Rashid entered the room. He also started hitting Raihan. ASI Ashek Elahi and Qutb Uddin were present in the room. Agents Touhid and Sajib were standing in the doorway to the room.
Soon after, the outpost in charge SI Akbar Hossain entered the room. He began to beat Raihan with a stick in Titu’s hand, asking for his name and address. Seeing his aggressive behavior, ASI Qutb told Akbar, “Sir, I am no longer.” Then Akbar sat on a bed in the room with a stick in his hand.
I woke up at 8:30 am to go to Sierra-4’s shift and saw that the place where Raihan had been hit was damp. At 9 in the morning we went to Osmani Medical’s department store for wounded and saw a body. Agent Touhid is by his side. Then I can recognize the body.
Saidur: Saidur told the court that Munshi Constable Aminul’s room at the Bandarbazar outpost held Constable Harun Raihan’s legs up high and SI Akbar and Constable Titu beat him on the legs and feet. At the time, ASI Ashek Elahi told Akbar that Raihan had misbehaved to the police and kicked him in the leg. There is no problem in kicking. Then Akbar threatened me and sent me to the sentry post.
After that I heard Raihan scream several times. At 4 in the morning I explained my duty to Agent Delwar and left. Saidur told the court that Munshi Constable Aminul from the Bandarbazar outpost called DC Sir (North Azbahar Ali Sheikh, SMP Deputy Commissioner) at 12:30 pm the next day and called him to the outpost.
After arriving, Akbar Sir said: ‘When the elders come, I will tell them that no one was taken to the outpost and tortured. He (Raihan) was caught hitting the people from the delivery house. They took him directly to Osmani Hospital. I will say what I say. With his hand on my chest, Akbar threatened Sir and said, “If I tell the truth, I will shoot you in the chest, I will come out with my back.”
Delwar: Like Saidur, SI Akbar also threatened agent Delwar Hossain, he told the court. Delwar told the court that while the bailiff was talking to him at the sentry post at the Touhid outpost, Akbar called Sir Touhid. Then Touhid came and said that Akbar Sir had called Raihan on his mobile phone and asked him to come to the outpost with 10 lakhs. Then Akbar said to Sir ASI Ashek Elahi: I fell asleep.
He takes Raihan to the hospital after a while. ASI Ashek Elahi went to prayers with Raihan’s uncle after Fajr’s call. After the prayers, Ashek Elahi told Raihan’s uncle, “Sir, he is asleep. He arrived after 9 am.” Around 8:20 a.m., ASI Ashek Elahi and Sheriff Harun Raihan were picked up and taken out in a GNC autorickshaw. They informed me that they were going to take him to Osmani Hospital. After half an hour, Akbar Sir woke up and hurried out of the outpost. At 8 in the morning I explained my duty to Sheriff Elías and left.
