Dhaka: The Superior Court has ordered the definition of the natural reservoirs of privately owned ponds in all municipal areas of the country, including metropolitan cities, divisions and districts.

The court said the ponds, which are registered as privately owned in all municipal areas of the country, including metropolitan cities, divisionals and districts, within a year of the verdict, are defined as natural reservoirs under Section 2 (f) of the Reservoir Conservation Act of 2000. Following the hearing on the writ, the court issued a judgment on September 30 of the same year and ordered a suspension.

In a subsequent rule hearing, advocate Manzil Morshed said that according to the provisions of the Environment Act 1995 and the Reservoir Conservation Act 2000, the filling of any reservoir is prohibited and even if it is a private pond , is included in the definition of a reservoir. The defendant’s lawyer said the pond is privately owned and does not include the metropolitan master plan, so the law does not apply in this case. He added that the case is pending in the civil court of Barisal. Therefore, the writ petition is not defensible.

The court heard statements from then-Attorney General Mahbubey Alam and Chief Counsel Prabir Niyogi in the court case to clarify the interpretation of the law.
