If the president of the USA, Donald Trump, infected by the coronavirus, becomes seriously ill and is slow to recover, what will happen to the presidential election on November 3? Can the election be postponed? Who or what can change this? Under the country’s law, the president himself cannot postpone the elections.
The incumbent president was attacked just 32 days before the presidential elections. As a result, fears have been created about the elections. The question arises as to what will happen if a presidential candidate dies before the election or if the president-elect dies before his inauguration or if the candidate is disabled.
Only United States legislators have the authority to postpone elections. If the election date is postponed, the proposal must obtain a majority in both houses of the United States Congress. Analysts say it’s unlikely because Democrats have a majority in the lower house, the US House of Representatives.
Postponing the date could mean so much more. Suppose both houses voted to postpone the election date. But according to the Constitution of the United States, the term of a president is exactly four years.
Under the constitution, President Trump’s term will automatically end on January 20, 2021 at noon. If the date of the election is changed, the constitution will also have to be changed.
This can only be done if two-thirds of the legislature or state legislature, and then three-quarters of the states in the United States, approve. However, something like this is less likely to happen.
What happens if the president cannot fulfill his functions?
If the president becomes so ill that he cannot fulfill his duties, he can transfer power to the vice president under the 25th Amendment to the United States Constitution. When the president recovers, he will return to his post.
If the president is not healthy enough to hand over power, his cabinet and vice president can declare him incapable of carrying out his functions, and the vice president can then assume the role of president.
If the vice president also does not fulfill his functions, the president of the House of Representatives will assume the position in accordance with the law called the Presidential Succession Law.
However, since the current Speaker of the House of Representatives, Nancy Pelosi, is a Democrat, constitutional experts say such a situation could lead to a legal battle.
If the speaker does not take office, then a high-ranking Republican leader, 6-year-old Charles E. Grassley, could assume the presidency. Of course, this can also lead to legal battles.
How many presidents have not been able to serve before?
Vice President George H. Bush became president in 1985 when President Ronald Reagan was hospitalized for cancer surgery.
Then, in 2002 and 2006, when President George W. Bush was anesthetized for a colonoscopy, his vice president took office.
In accordance with party rules, the national committee will elect a new presidential candidate. Perhaps this is how Mike Pence can debut as a new candidate, but then a new running mate will also have to be chosen. Never before in the history of the United States has such a situation been created.
But many of the votes in the elections have already been given, what will happen to them? – That question has also been raised. Experts say this will create a lot of uncertainty. Because millions of votes have already been sent.
Rick Hassen, a law professor at the University of California, Los Angeles, said voting would continue with ballots with the names of the disqualified candidates. But the question is whether the new candidate who will replace him will be able to be voted by the electoral colleges of the states.
Can the name be changed on the ballot?
“Whatever happens, President Trump’s name will almost certainly be on the ballot,” said Richard Plydes, another American law professor. He said the Republican Party may go to court to change the candidate’s name, but in reality there will not be enough time for him.
If Trump can’t run, what name will appear on the ballot? If a candidate for the presidency cannot run for some reason, there are clear rules.
In that case, Vice President Mike Pence will run for president, but will not be considered a Republican candidate.
