MC College dorm rape, lawyers don’t fight on behalf of defendants

No attorney will go to court on behalf of the defendant in her husband’s gang rape case in Sylhet MC College dorm. They strongly condemned the incident and demanded punishment for the perpetrators. Attorneys say they will cooperate fully with the state for exemplary punishment of the accused. The Sylhet District Bar Association is known to have made no decision not to provide legal assistance to the defendants. However, lawyers do not fight on behalf of the accused on humanitarian grounds.

The court’s defender of APP, Khokon Kumar Dutt, said that no attorney appeared on behalf of the defendant at the bail hearing. As there was no attorney for the defendants in court, the court wanted to know the defendants’ statements and said they were not involved in the rape incident. At this moment they affirm their innocence.

Furthermore, he said: “From a humanitarian point of view, Sylhet’s lawyers are not fighting for the accused of their own free will.”

ATM attorney Fayez Uddin, president of the Sylhet District Bar Association, said: “We have decided not to fight for any of the defendants in this case, although we have not officially taken it up.” But if the plaintiffs want our legal help, we are ready to provide it on humanitarian grounds.

He further stated: “Due to the protracted nature of the case, the court also appointed attorneys for the defendants at some point. This is called state defense in legal parlance. However, such an environment has not yet been created in this case. In short, no attorney for Sylhet is willing to fight for these defendants.

Attorney Habibur Rahman of the Sylhet District Bar Association said: “The lawyers of the Sylhet District Bar Association are unwilling to fight on behalf of the defendants in the rape case. Many do not fight alone. We will work for the state, but we will not fight for the accused. I demand exemplary punishment for this heinous incident.

It emerged that on Monday (September 26) at noon, the main defendants in the Saifur and Arjun Lashkar case were brought before the court and the investigation of the Shahpuran Police Station Indranil Bhattacharya requested a preventive detention of 7 days. During the hearing, around 6-7 lawyers on behalf of the plaintiff agreed with the police statement and requested the preventive detention of the accused for questioning. As there was no lawyer for the defendants at the time, the court judge wanted to know the statements of Saifur and Arjun. They told the court: ‘We are not involved in the bedroom incident. We did not commit any crime. Rajan, Tareq and Ainuddin caused this incident. After hearing their statement, the judge of the Second Metropolitan Court of Sylhet, Saifur Rahman, granted them a five-day preventive detention.

On the other hand, on Tuesday (September 29) at noon, the investigating officer of the case, Mahbubur Rahman Rony, Rajan Mia and Ainuddin, named as Ezhar No. 3 in the rape case, requested the preventive detention of 7 days in the same court and the judge granted 5 days of preventive detention to each. As there was no lawyer for them at that time, the judge wanted to know the statements of the defendants. Later, the court granted his preventive detention.

Incidentally, on September 25, a couple visiting MC College was arrested and forcibly taken to the dormitory by BCL leaders and activists. Then she tied up the husband, beat her, and raped her wife. The victim’s husband filed a case at the Shahparan Police Station on Friday night. Six people have been named as defendants in the case. At the same time, two or three more unidentified people were charged. The defendants are: M. Saifur Rahman, Shah Mahbubur Rahman Rony, Tareq Ahmed, Arjun Laskar, Rabiul Islam and Mahfuzur Rahman. Everyone is involved in the politics of the Chhatra League. Among the defendants, Tareq and Rabiul are outsiders, the rest are MC College students.
