Bail statement rejected in two money laundering cases

Destiny’s Doctor Rafiqul Amin must remain in jail. The Appeals Division has rejected two bail statements in two cases of smuggling of Rs 3.5 billion on the grounds of illness. A bench of four judges from the Appeals Division headed by Chief Justice Syed Mahmud Hossain approved the order today.

Following the order, Rafiqul’s attorney, Saeed Ahmed Raja, requested an audit to determine the value of Destiny’s current assets. The Chief Justice said there was now no scope for an audit.

The Appeals Division had ordered the release on bail of Rafiqul Amin, MD of Destiny, on the condition of paying Tk 2,500 crore after selling 35 lakh trees. The Appeals Division issued the order in 2016 in response to a proposal from his attorneys. Rafiqul Amin did not comply with the order even after four years. You have now applied to the Appeals Division for a new sick bond. During the hearing on that request, the Appeals Division told Destiny’s lawyer on Thursday, alleging embezzlement of millions of rupees against him. Whose money is this? We gave you a conditional bond. But didn’t you accept that? You have promised not to return a penny to the customer. A bench of four judges from the Appeals Division headed by Chief Justice Syed Mahmud Hossain made the comments during the bail hearing.

Rafiqul Amin’s lawyer, Abdul Matin Khasru, said at the hearing that Destiny has 5 million clients. Although none of them complained of embezzlement, the ACC has filed a lawsuit against them. She has been in prison for eight years. Physically ill. Bail is required. Who will judge when I die? He said, is it possible to sell 35 lakh trees from the jail and pay 2.5 billion rupees in six weeks? The Chief Justice said, “We gave the order after accepting your (Destiny) statement.”

Judge Hasan Fayez Siddiqui said: “So far you have not paid a single penny.” Judge Obaidul Hasan said, if you can’t pay even if you get out of jail, what will happen to the bail? Matin Khasru said, who will judge me when I die?

Opposing bail, ACC prosecutor Khurshid Alam Khan said 162 people had testified in the case. The Superior Court has asked that the case be resolved within six months. They claimed that Rafiqul Amin had been in prison for eight years, but had spent six of those eight years in hospital. And on the basis of the Bangladesh Bank report, a 3.5 billion rupee money laundering case has been brought against him. Why would Destiny customers sue? You are a Canadian citizen. You can escape on bail.

CAC’s lawyer said that the Appeals Division had granted a conditional bond based on the proposal of Rafiqul Amin’s lawyers. It is not an order imposed by the Supreme Court. Even if I came to you (Appeals Division) with a deposit of one hundred crore rupees, I would not be able to pay. But without depositing money, you now submit a new bail request.

At this stage, for the purpose of the ACC lawyer, Judge Obaidul Hasan said, will Rafiqul Amin not appear in the lower court during the trial? ACC’s attorney said he failed to show up 4 out of 5 times. When the date of the witness is set, he brings the request and the prison authorities report that he is ill and it is not possible to present him.

Opposing bail, the state’s additional attorney general, Murad Reza, said the tree did not exist. And this tree is Rafiqul Amin? Destiny has committed a crime. And as the CEO of Destiny, he is responsible for that crime. That is why he is in jail. How did you come up with a new bail request without complying with the Supreme Court order? At that time, the Appeals Division also raised the issue of the recovery of money from the Sahara Group of India. The court said a meeting would be held inside the jail if necessary. But they have violated the order of the Appellate Division.

Matin Khasru said, I have asked for a bond showing the cause of the illness. Here is the medical certificate from Bangabandhu Sheikh Mujib Medical University Hospital. The Chief Justice said he is receiving treatment at the best hospital in the country. Matin Khasru said it was difficult to receive treatment in the prison cell. Murad Reza said he was receiving treatment in a hut, not a prison cell. After the hearing, the Appeals Division set Sunday as the date for the order.

The ACC has brought two cases against Destiny’s Dr. Rafiqul Amin, President Mohammad Hossain and several others for smuggling money worth Rs 3.5 billion. Following Rafiqul Amin’s request in the case, he was released on conditional bail on November 13, 2016. The order said the 35 lakh trees should be sold in six weeks and 2,600 Tk crore should be deposited in the government treasury . Rafiqul Amin and Mohammad Hossain, the two leaders of Destiny, will be released on bail only if they present a copy of the deposit to the lower court. The Appeals Division had directed the ACC chairman to distribute the money deposited in the government treasury to the affected individuals through Destiny.
