- The Supreme Court has fined lawyer and social activist Prashant Bhushan one rupee for contempt of court.
- You have been asked to present the fine to the court before September 15.
- Otherwise, you could face up to three months in jail.
- Even working as a lawyer could be suspended for three years, the superior court said.
Prominent lawyers, including former judges and even intellectuals, have written letters to Prashant Bhushan. Attorney General KK Benugopal also mentioned the contribution of the eminent veteran lawyer during the hearing of the case. His plea to Judge Arun Mishra was: “Do not punish Prashant Bhushan.” After that, 122 law students wrote open letters to Chief Justice SA Bobre and Judge Arun Mishra requesting not to punish Bhushan.
According to Article 129 of the High Court Rules of contempt, in all these cases a maximum of six months’ imprisonment or a fine of Rs 2,000 or both could be combined.
What is Bhushan’s punishment today? Look at the Supreme Court
“Under this law, we have seen the imprisonment of former judge CS Karnan,” Abhijit Sengupta, lead counsel for the former permanent state attorney at the New Delhi Supreme Court, said on Sunday. Previously, the Supreme Court stripped veteran attorney RK Anand of his “senior” status after he was found guilty of contempt of court. The high court had banned the practice of a prominent lawyer from the Uttar Pradesh Bar Association for six months in an attempt to convict him. He unconditionally apologized but was not spared Also in this case, it should be noted that this time Prashant Bhushan did not apologize in the contempt of court case, he stood firm in his position.
One thing is noteworthy about this. Even if Bhushan’s sentence is announced today, it will not take effect immediately. Because you have a petition for review, which will be heard by another court. Since Judge Arun Mishra will be retiring on the 2nd, another court will hear the petition for review. The sentence will not be effective until the request for review is decided.
