Zelensky signed a law that fully restores the work of NAPK

The President of Ukraine, Volodymyr Zelenskyy, signed the Law on Amendments to the Law of Ukraine for the Prevention of Corruption, which the parliament approved on December 15. In this way, the powers of the National Agency for the Prevention of Corruption, which were blocked by the Constitutional Court, are fully restored.

It is reported that the document eliminates the legislative loopholes that arose due to the decision of the Constitutional Court of Ukraine on the unconstitutionality of certain provisions of the Law on Prevention of Corruption and ensures the full functioning of the NACP.

The law also establishes additional characteristics of the exercise of the powers of the NACP in relation to judges, judges of the Constitutional Court, aimed at ensuring compliance with the guarantees of independence of these people.

In addition, in relation to the judges, the details of conducting complete controls of the statements and monitoring their lifestyle have been established; provided legal regulation on liability for corruption and crimes related to corruption.

As they write in the OP, such an approach will take into account the decision of the Constitutional Court and will preserve the effectiveness and proportionality of the institutional mechanism to prevent corruption.

Likewise, access to the Unified State Registry of Declarations of Persons Authorized to Perform the Functions of State or Local Self-government will be open 24 hours a day.

Scandalous decision of the KSU

On October 27, the Constitutional Court canceled art. 366-1 of the Criminal Code of Ukraine on criminal liability for entering inaccurate data in the declaration, which endangers the visa-free regime with the EU, international financial assistance and Ukraine’s European Integration Directorate.

The Constitutional Court also recognized as unconstitutional the powers of the NAPC to control and verify declarations, 24-hour access to the registry of declarations, and lifestyle monitoring.

The scandalous decision of the CCU was taken at the proposal of 47 popular deputies of the party Opposition Platform: Lifetime and parliamentary group For the future.

The NAPK said the judges made the decision in their own interest. According to the anti-corruption agency, two members of the KSU entered inaccurate information in their statements and probably tried to evade responsibility.

Following the scandalous KSU decision, several high-profile cases were closed, including that of Odessa Mayor Gennady Trukhanov, Attorney General Irina Venediktova, Interior Minister Arsen Avakov, former Ukroboronprom Director Pavel Bukin, as well as the Constitutional Court judge Vladimir Moysik.
