VAKS overturned another verdict for lying in statements

The former director of the Lviv Armored Plant, Roman Tymkiv, will not be held responsible for the lack of declaration of the company in Belize and the apartment in Vienna.

The Supreme Anti-Corruption Court, due to the decision of the Constitutional Court on declarations, overturned the verdict of the former director of the Lviv Armored Plant, Roman Tymkiv, who had previously been found guilty of declaring false information. This was announced on Thursday, November 19, by the press service of the National Agency for the Prevention of Corruption.

“On November 19, VAKS overturned the verdict against Roman Tymkiv. This was made possible by the decision of the Constitutional Court of Ukraine (CCU) on October 27, 2020, which abolished the responsibility to declare false information,” emphasized the NAPK.

It is noted that Tymkiv appealed to the court with the requirement to accept an acquittal against him due to the absence of evidence of crime in his actions one week after the decision of the Constitutional Court.

During the trial, the defendant’s lawyer, Vladimir Zhukov, once again confirmed the inaccurate statement: “Yes, in fact, my client did not indicate in the statement what property he owns.” However, such actions do not attest and in general it could never be attested that they are very dangerous or socially dangerous both for society and for the State, other legal entities or persons ”, said the lawyer.

Roman Tymkiv in his statements for 2017-2018 did not indicate the company Aventa Investment Limited with a share capital of $ 50,000 and an apartment in Vienna that belongs to a member of his family. Tymkiv pleaded totally and unconditionally guilty.

Earlier it was reported that director Roman Tymkiv, suspected of embezzling million-dollar funds, was fired two years later.

Let us remind you that a few days earlier, VAKS canceled its verdict for the first time in relation to the willful failure to file electronic returns. The retired judge of the Dnipropetrovsk Region Court of Appeal, accused of deliberately failing to submit electronic statements, was acquitted of guilt.

As you know, on October 27, the judges of the Constitutional Court in closed session declared criminal responsibility for inaccurate declaration unconstitutional, which caused a great political and public outcry.
