The president of the Ukrainian Bar Association, UAF lawyer Denis Bugay gave his assessment of the decision of the Swiss authorities to cancel the match.
“The local authorities were clearly aware of the negative consequences that this decision could have for the Ukrainian team, in particular a demotion in the division. But the Swiss team did not take any action to verify the validity of their doctor’s decision. This it’s the first.
Second, other players on the national team were unreasonably denied PCR testing. Third, they refused to retest Malinovsky, Moraes and Krivtsov.
On 6 November, the Lucerne Canton Health Department allowed Lucerne to participate in the game against Zurich if one of the players tested positive. And such different approaches to admitting foreign and local teams to the match raise reasonable doubts.
From a legal point of view, these actions contain signs of discrimination against the Ukrainian side, which is prohibited by generally recognized principles and norms of international law.
Since the cancellation of the match with Switzerland affected not only the Ukrainian national team, but also the rights of all players, this is an opportunity to use the tools of the European Court of Human Rights (ECHR) to protect their rights.
The corresponding appeals and lawsuits will be initiated before the Swiss administrative and judicial authorities to protect the interests of the national team.
If the latter do not react to the serious violations of the rights of the Ukrainian team and the acts of discrimination, the matter will be referred to international organizations, ”said Bugay.
