The head of the Constitutional Court, removed by the president, said that the procedure for the resignation of the judges of the Constitutional Court is determined by the Constitution and issued instructions to the employees of the Constitutional Court.

Alexander Tupitsky signed an order on Friday, April 2, in effect declaring the illegality of President Volodymyr Zelensky’s decree to cancel Tupitsky’s appointment as judge of the Constitutional Court. The corresponding document was published by the ZN.UA.

The first paragraph of the document is an appeal to the deputy director of the KSU Sergei Golovaty:

“To the Deputy Head of the Constitutional Court of Ukraine SP Golovaty, in order to avoid the introduction of destabilization in the activities of the Constitutional Court of Ukraine, stop taking measures that go beyond the powers determined by the order of the President of the Constitutional Court of Ukraine Ukraine No. 81/01/2020-OD dated December 21, 2020, dated February 9, 2021 No. 5/01/2021-OD “.

At the same time, Tupitsky points out that during the period of remote work, his powers are not transferred to the vice president of the CCU. Tupitsky also warns of criminal liability for “misappropriation of powers.”

The publication, which cites KSU sources, notes that Golovaty was in Bankova on the eve of the presidential decree on the removal of Tupitsky. Some attribute the idea of ​​the document to him.

Tupitsky also requires all KSU judges and employees to act exclusively within the law, to inform you of all illegal orders and threats if you receive them.

As pointed out by ZN.UA, the publication of such a document is an attempt by Tupitsky to take control of the processes that take place in the KSU, and also to answer the doubts about the legitimacy of Tupitsky among the judges.

As reported, on March 27, Zelenskiy issued a decree that reversed the decrees of former President Viktor Yanukovych on the appointment of Tupitsky and Kasminin as judges of the Constitutional Court. After that, Zelensky said that Tupitsky no longer runs the KSU.

In response to this, Tupitsky calls a special meeting of the CCU on April 12. Also on Monday it emerged that he had appealed against Zelensky’s decree in the Supreme Court.
