The Court of Justice of the European Union reversed the decision to impose sanctions on Mykola Azarov. The court considered the complaint of the former prime minister’s lawyers against the decision of the EU Council of March 4, 2019 to leave him on the list of people against whom sanctions were imposed.
This is stated in the judicial decision of December 16.
The European Court ruled that the EU Council did not control the application of the Ukrainian judicial system of the right to defense of Azarov and the right to effective judicial protection in criminal proceedings.
“It follows that by deciding to keep the applicant’s name on the list, the Council of the European Union erred in judgment. In these circumstances, the contested actions should be annulled insofar as they relate to the applicant, unnecessarily to consider your request for measures to organize the procedure “, – decided the EU court.
Given this, the court suspended the EU decision to impose sanctions on Azarov. Legal costs must be paid by the Council of the European Union.
Recall that in March 2020, the European Union officially lifted the sanctions against the former Prime Minister of Ukraine, Azarov. Along with him, former Energy Minister Eduard Stavitsky was also excluded from the sanctions list.
