The Verkhovna Rada has taken a step towards updating administrative legislation. The People’s Deputies approved the corresponding bill No. 3475 “On Administrative Procedure” as the basis for the first reading.

The purpose of the document is to establish the procedure for actions of state authorities when providing administrative services to Ukrainians, such as granting a building permit, assigning a housing subsidy or registering land.

The project defines the thematic composition of the administrative process. Separate chapters of the document determine the status of the administrative body, the composition and the status of the participants in the administrative process, as well as the people who assist in the consideration of the administrative case (witnesses, experts, specialists, translators), their rights and obligations .
The law prescribes the procedure for the submission and registration of an application, an application form and requirements for its content, conditions for leaving an application without movement / submitting an application for membership. It also defines the conditions under which applications are not subject to consideration.
The administrative appeal is highlighted in a separate section of this bill. The complaint will be considered by a higher level administrative body, as well as a commission formed by the administrative body to consider the complaints.
The document also determines the procedure to revoke or invalidate an act, provides for a review of an administrative act for recently discovered circumstances, and the like.
In addition, the law prescribes the procedure for calculating the deadlines in administrative procedures and establishes the deadline for the decision (review) of the case.
Let us remind you that in Ukraine, the court fee can be canceled when appealing against a decision to collect an administrative fine: BP adopted the corresponding bill No. 3424 as the basis.
