The Office of the Prosecutor General of Ukraine is about to begin extradition of Yanukovych

On the eve of the Pechersk district court, in absentia, Viktor Yanukovich, a former President of Ukraine, who was hiding in Russia, was arrested in case of usurpation of power. The Attorney General’s Office said this decision allows the procedure for his extradition to begin.

Office of the Prosecutor General of Ukraine declared on the intention to start the extradition of the former fugitive President of Ukraine Viktor Yanukovich.

“On May 4, at the request of prosecutors in the Office of the Prosecutor General, the Kiev Pechersky District Court chose Yanukovich a restraining measure in the form of detention in criminal proceedings for the seizure of state power. […] The decision entitles the prosecution to initiate an extradition process against Yanukovich. In addition, prosecutors will ask the court for permission to conduct a special [заочного] pre-trial investigation, “the report said.

The Attorney General’s Office recalled that in this criminal proceeding they are investigating “the circumstances of Yanukovich’s seizure of state power from September to October 2010 by taking measures aimed at illegally increasing the volume of his legislative and executive powers as president from Ukraine”. It is a decision of the 2010 Constitutional Court of Ukraine, which expanded Yanukovych’s powers and actually returned the 1996 Constitution.

The usurpation of power case was opened on April 8, 2015. The judges of the Constitutional Court of Ukraine (KSU) were questioned as witnesses by the Prosecutor General’s Office. INSIDER claims that the witnesses are six KCU judges, who decided to withdraw the 2004 Ukrainian Constitution. The case also includes the former Minister of Justice of Ukraine Oleksandr Lavrynovych.

Yanukovych was convicted in absentia on January 24, 2019 by the Kiev Obolonsky District Court for high treason and complicity in conducting an aggressive war, and sentenced him to 13 years in prison. The court did not find proven the guilt of the former president for violating the territorial integrity of Ukraine. The former president was not involved in the process. After fleeing Ukraine in February 2014, he lives in Russia.
