The lawyers pointed out the illegality of SAP’s suspicion of Tatarov
The acting head of the Anticorruption Prosecutor’s Office does not have the right to sign suspicions before lawyers.
The acting head of the SAP, Maxim Grischuk, violated the requirements of the Criminal Procedure Code and the Law of Ukraine on the Bar Association, signing a suspicion to the deputy head of the office of President Oleg Tatarov. This is indicated in a message on the association’s website on Friday, December 18.
They recalled that a notification of suspicion to a lawyer can only be made by the attorney general, his deputy, the prosecutor of the Autonomous Republic of Crimea, the region, the city of Kiev and the city of Sevastopol.
“The head of the Anti-Corruption Specialized Prosecutor’s Office is the Deputy Attorney General by position, however, the person who acts as head of the SAP does not acquire full powers. Therefore, Maxim Grischuk, while acting as head of the SAP, committed abuse of power This is a criminal offense and must be investigated by the State Investigations Office, “the message says.
The lawyers point out that Grischuk and the head of the SAP department, Andrei Dovgan, have no procedural rights to hand over the suspicion to Tatarov without the power of the attorney general.
“Attorney Oleg Tatarov provided legal assistance to the Ukrbud company and its officials. In initiating criminal proceedings against him, the SAP and NABU detectives illegally identified the lawyer with his client and took steps to interfere with the lawyer’s private communication with your client, “said the association.
Tatarov himself considers that the suspicion is the liquidation of personal accounts and promises to prove his innocence.
“In connection with publications in the media about attempts to arouse suspicion, I once again declare my public position. Sytnik is an official and a state criminal who has been found guilty of corruption and settles personal scores. , – wrote in a telegram.
