Criminologist Anna Malyar believes Ukraine should have sued the International Criminal Court (ICC) in The Hague hold Russia accountable for its aggressionbut this was not done.
In a comment to Gordon, he noted that the Rome Statute even there was a special definition for this.
“Why don’t we demand that the ICC investigate Russia’s aggression? For me, the most important thing is to punish the Russian Federation for the war. Yes, I understand that since the Nuremberg trials, the courts have not brought anyone before justice for assault. But we could endeavor to set a precedent and become the first, because we have a lot of evidence. Further, The definition of aggression has already appeared in the Rome Statute.“, – said Malyar, who is also a candidate for Legal Sciences and head of the Center for Legal and Criminological Research.
He also explained that the country that signed the Rome Statute allows the court to investigate four groups of crimes in its territory: against humanity, war crimes, genocide and aggression. However, Ukraine did not sign it, but allowed partial jurisdiction over two categories: war crimes and crimes against humanity.
Furthermore, the expert believes that decision of the Ministry of the Interior – this is far from a win… However, this is an unequivocally positive sign, because, although it is slow, there is progress.
As OBOZREVATEL previously reported, on December 11, the International Criminal Court for War Crimes and Crimes Against Humanity declared that there were grounds for an investigation against the Russian Federation for its aggression in Ukraine. Foreign Minister Dmitry Kuleba called this decision historic.
On December 14, the ICC prosecutor’s office completed a preliminary analysis of the Russian aggression and published a report.
