The Sixth Administrative Court of Appeal of Kiev annulled the decision of the District Administrative Court to recognize as illegal the conclusion of the Institute of National Commemoration that the symbols of the SS “Galicia” are not Nazis and therefore are not subject to the prohibition of the symbols of the Communist and National Socialist regimes.
This was announced by lawyer Lyudmila Braslavskaya, reports Ukrainian News.
“Unfortunately, the decision is negative for us,” he said.
As noted in court, he represented the interests of Natalya Myasnikova, who asked the court to declare illegal then-director of the National Institute of Remembrance Vladimir Vyatrovich’s response to Strana’s request in 2017.
In her complaint, the applicant pointed out that the SS Galicia division was part of the Waffen-SS troops, which the Nuremberg Tribunal had declared a criminal organization in 1946.
In his opinion, the former head of the National Memory Institute misrepresented historical facts and exceeded his authority.
Braslavskaya said that today the court considered the appeal of the Institute of National Memory and satisfied it, thus annulling the decision of the court of first instance, which recognized the symbols of the SS “Galicia” division as Nazis.
The lawyer also stated that this court decision was a surprise to her and that she was lost. She stressed that she will present an appeal before the Supreme Court against the decision of the Court of Appeals.
Recall that in May, the Kiev District Administrative Court declared illegal the conclusion of the Institute of National Commemoration that the symbols of the SS Galicia division were not Nazis and, consequently, were not subject to the laws prohibiting symbols of Communist and National Socialist regimes. At the same time, the court satisfied the claim of the natural person Natalya Myasnikova only partially and rejected other parts of her claim. In particular, it did not prohibit the “propaganda of the SS symbols” Galicia.
Previously, the Institute of National Remembrance called the Obersturmführer of the SS Galicia Division “Lieutenant”.
