Aleksey Vats, Servant of the People’s Kharkiv council deputy candidate, filed a lawsuit to annul the election results and invalidate them. The court partially confirmed the claim, canceling the Kharkiv City Territorial Elections Commission protocol, but refused to force the TECs to recognize the elections as invalid and appoint a repeat one.
The Second Administrative Court of Appeal canceled the Kharkiv City Territorial Electoral Commission (TEC) protocol on the results of the elections for city deputies. This was reported on November 14 by Ukrainskaya Pravda, which has a court decision at its disposal.
As the journalists point out, the corresponding claim was presented by the candidate for deputy of the town council of the “Servant of the People” Aleksey Vats. He asked to declare illegal and cancel the protocol of the TEC of the city of Kharkiv and force the electoral commission to declare the elections invalid and appoint a new one.
The candidate justified it by the fact that the TEC had accepted more than 100 protocols of seal commissions, which were not stitched, contained incorrect numbers, corrections by a proofreader, etc. Because of this, they were sent for review.
However, the district court dismissed the claim. After that, Vac filed an appeal, arguing that the court had made a decision based on inappropriate and unreliable evidence that was provided to the TEC.
When assessing the actions of the TECs, the Court of Appeal recalled the decision already adopted to count the votes in certain precincts in the demand of the Opposition Platform – For Life party.
As a result, the court resolved to satisfy the appeal in part, reversing the district court’s earlier decision.
Thus, the second court of appeal annulled only the protocol, but refused to force the territorial commission to recognize the elections as invalid and appoint a repeat one. At the same time, the court decided that the TEC should “continue actions to establish the results of the elections of deputies of the Kharkiv City Council.”

The results of the Kharkiv City Council elections were known in early November, five political forces surpassed the five percent barrier: the Kernes bloc: successful Kharkiv, OPSZ, Servant of the People, Svetlichnaya Bloc Together and European Solidarity.
On October 25, local elections were held throughout Ukraine, except for annexed Crimea and the occupied regions of the Donetsk and Luhansk regions. Citizens of Ukraine elected heads of cities, towns and municipalities, as well as deputies of regional, district, city, town and village councils. The elections were held for the first time in accordance with the new Electoral Code, according to the proportional system with open lists. According to the Central Election Commission of Ukraine, participation was 36.88%.
