The authors of the submission ask the court to declare unconstitutional the provisions of the law that define NABU as a state law enforcement agency.

The Grand Chamber of the Constitutional Court on Thursday 10 September began to consider the presentation on the constitutionality of the law at the National Anti-Corruption Office of Ukraine. This was reported by the Ukrinform news agency.

The examination of the case is carried out with the participation of representatives of the authors of the presentation: the deputies of the Verkhovna Rada of the OPLZ Vasily Nimchenko and Grigory Mamka, as well as the Deputy Attorney General Roman Govda.

Also present are the president of the Supreme Anti-Corruption Court Elena Tanasevich, the president of the Supreme Court Valentina Danishevskaya, the director of the National Agency for the Prevention of Corruption Alexander Novikov, the Minister of Justice Denis Malyuska.

The authors of the submission ask the court to declare unconstitutional the provisions of the law that define NABU as a state law enforcement agency.

The deputies also dispute the powers of the president to create NABU, appoint and remove its director, appoint three members of the commission for the selection of a candidate for the director of NABU, and approve regulations on the NABU Public Control Board.

The authors of the letter affirm that the provisions of the contested law contradict art. 6, 8, 19, 85, 106, 113,116 of the Constitution.

Earlier, the president of the Verkhovna Rada, Dmitry Razumkov, said that in order to solve the problem of the appointment of the director of NABU, it is necessary to amend the Constitution or legislation.
