VAKS as a court of first instance considers 172 criminal cases, two of which refer to the declaration of false data.

The Supreme Anticorruption Court (WACC) closed 15 cases and annulled three sentences due to the Constitutional Court’s decision to abolish criminal responsibility for lying in statements. On Wednesday, December 16, the agency reported. Ukraine News.

“Since the date of the adoption by the Constitutional Court of Ukraine of the decision of October 27, 2020 No. 13-r / 2020 VAKS, 13 criminal proceedings have been closed under Article 366-1 of the Criminal Code of Ukraine. In addition, 2 processes have been closed in terms of charges under Article 366-1 of the Criminal Code of Ukraine “, – indicated in the message.

Furthermore, it is noted that the court considered the requests for review of judicial decisions, after which it canceled three sentences and closed the relevant proceedings in cases of a crime under article 366-1 of the Penal Code. Two more requests for review are pending.

Overall, as of December 15, VAKS as a court of first instance considers 172 criminal cases. Of these, two processes, in which people are accused of declaring false information (Art. 366-1 of the Penal Code).

At the same time, they added to the UN, there are 16 criminal cases in the WACS Appeals Chamber, three of which are open to appeals against a judicial decision to close the process in a criminal offense under article 366-1 of the Code Criminal, for its recognition as unconstitutional.

“The decision to close such cases was not made by the Appeals Chamber,” the newspaper said.

As reported, in November, due to the decision of the Constitutional Court of Ukraine, the Antikorsud canceled its verdict for the first time. It was approved against a retired judge of the Dnipropetrovsk Region Court of Appeal, Nadezhda Posunsya, accused of deliberately failing to submit electronic statements.
