The National Bank of Ukraine has refused to the citizen of the Republic of Belarus Nikolay Varaby to accept the acquisition of a substantial stake in the amount of 100% of the authorized capital of BTA Bank JSC. The decision was made because the applicant’s business reputation is not impeccable.

As noted in the message of December 17, 2020, by decision of the EU Council No. 2020/2130, Varabei is included in the list of people to whom personal restrictions (sanctions) have been applied.
“According to the requirements of the regulatory legal acts of the National Bank, the application of sanctions to a person is the basis for the loss of an impeccable business reputation during the term of the sanctions and three years after their lifting,” says the message.
In addition, one of the reasons for the decision was the failure to provide sufficient documents and information to confirm compliance with the financial condition of the applicant and the sources of its own funds with the requirements of Ukrainian legislation, added to the NBU.
According to the NBU, now the controller of BTA Bank JSC is a citizen of Kazakhstan Kenes Rakishev.
Nikolai Varabei is a Belarusian businessman, owner of the Interservice and Oil Bitumen Plant companies for the wholesale trade of petroleum products, the Absolutbank bank and other companies. It also owns a majority stake in Ukraine’s Prikarpatzapadtrans petroleum products pipeline. On December 17, 2020, the European Union sanctions were imposed on Varabya.

Please note that Kenes Rakishev received approval from NBU for the acquisition of a significant stake in BTA Bank in February 2016.
