German law enforcement agencies cannot open a case and investigate the poisoning of Alexei Navalny (a leader of the Russian opposition). The case is not currently under German jurisdiction.

Even before Chancellor Angela Merkel announced Navalny’s poisoning with Novichok, the federal government reportedly asked the Karlsruhe Attorney General for clarification. In particular, she was asked to clarify whether an investigation could be carried out in Germany.
However, since it is not a war crime, Berlin cannot invoke universal jurisdiction under the International Criminal Code. The Navalny poisoning took place in Russia – this is the main difference between the Skripals case on British soil and the British victims.
According to the Ministry of Justice and the Berlin state judicial system, the investigation will be possible if Navalny dies in Germany. At the same time, the judiciary may intervene if his condition deteriorates significantly.
We will recall, previously NATO demanded a transparent investigation from the Russian Federation into the Navalny poisoning.
After being transferred to the German Charite clinic, Navalny’s condition improved significantly. After a few days in a coma, he fully regained consciousness, was already disconnected from the ventilator, and got out of bed.
