The decree of the Cabinet of Ministers on the restriction of the weekend violates a number of provisions of the Constitution, say the deputies.
A group of 48 popular deputies submitted a brief to the Constitutional Court, in which certain provisions of the decree on the introduction of the weekend quarantine were appealed, the court’s press service reported on Monday, November 23.
The authors of the petition believe that certain provisions of this resolution do not comply with a series of norms of the Basic Law of Ukraine, and also point out that the issues raised in the constitutional presentation are of special social and economic importance, since they refer, among other things, to the life and health of citizens.
The submission is pending trial.
According to Olga Sovgirya, Deputy Head of the Verkhovna Rada Legal Policy Committee, the people’s deputies will only appeal against certain provisions of the Cabinet of Ministers in weekend quarantine.
“The constitutional brief alleges that the restrictions introduced violated the equal rights and constitutional freedoms of citizens, as a result of the prohibition of working for some citizens, while others do. According to the authors of the brief, the prohibitions appealed in the brief they are unconditional, and their actual implementation leads to significant (more than 50%) revenue losses (profits) of business entities operating in different economic areas “, – the MP wrote to Facebook.
They also appealed against the provision prohibiting scheduled hospitalizations. The authors believe that this violates article 49 of the Constitution, as there is a selective focus on the provision of medical care.
In addition, the appeal against the decision, since the restrictions imposed without the introduction in Ukraine of war or state of emergency, which is a prerequisite for limiting the number of constitutional rights under Article 64 of the Constitution of Ukraine.
“Please note that the subject of the appeal in this presentation is not the introduction of quarantine as a whole,” Sovgirya said.
Recall that restaurateurs and representatives of other business areas have repeatedly protested against the introduction of the weekend quarantine. In particular, 7 km market workers protested in Odessa the day before.
