The court recognized the obligation to declare the property as constitutional, but did not take responsibility for inaccurate data.
The Constitutional Court of Ukraine on Tuesday, October 27, declared unconstitutional criminal responsibility for inaccurate declaration. This decision was made by the Grand Chamber of the Constitutional Court of Ukraine, Ukrinform reports, citing an informed source.
“The Constitutional Court has declared article 366-1 of the Penal Code and the control powers of the NAPC unconstitutional,” the source said.
At the same time, the agency interlocutor pointed out that the court recognized the obligation to declare the property constitutional.
Article 366-1 of the Penal Code establishes responsibility in the form of a fine or imprisonment for the presentation of deliberately false information by the declaring subject in the declaration of a person authorized to perform the functions of the state or local government.
Let us remember that in February 2019, the CCU canceled the article on illegal enrichment, since its provisions violate the presumption of innocence.
The KSU later clarified that the document contradicts legal certainty as part of the rule of law.
