The head of the Ministry of Justice, Denis Malyuska, is sure that the liquidation of the Kiev District Administrative Court will change little, and therefore other options should be considered, in particular with regard to its reorganization. “On the contrary, (the liquidation of the court – ed.) Can sometimes have some negative consequences if not considered. Another thing is if the decision is made to transfer jurisdiction of part of the disputes that the UASC resolves to another court. Or even almost everyone. Or merge the OASK with another court. Such scenarios will do less damage than a simple and elementary liquidation of the OASK. Because if we settle the OASK, it means that the whole range of disputes, and they are considering a lot of disputes, must be considered by another. The question is: who? For what resources? “- Malyuska explained.

According to him, in the situation with the OASK, few doubt the professionalism of the judges.

“The judges are professionals and know the legislation very, very well. They doubt virtue and ethical standards. This is key,” the minister continued.

Malyuska also evaluated the petition to President Volodymyr Zelensky demanding the elimination of the UASC as a political appeal.

“We need to do something with OASK so that it stops generating these dubious judicial decisions so that it can be trusted again. How to do this? Reorganization, merger or transfer of powers to another court, or transfer along with liquidation?” There are several steps to take, but it is already under consultation “, summarized Malyuska.

Let us remind you that in September the SCJ refused to dismiss the judges of the Kiev Administrative Court. The attorney general’s office did not provide evidence that UASC judges have the ability to influence witnesses and suspects, the SCJ states.

Already at the end of October, Zelensky gave instructions to study the issue of the liquidation of the OASK. In this regard, the head of state ordered to consult with the Superior Council of Justice, over which, according to the investigation, the head of the UASC was trying to establish control.
