KSU to consider removal of Alexander Tupitsky
The Constitutional Court does not have authority on its own initiative to consider questions about the constitutionality of any act.
The judges of the Constitutional Court of Ukraine on Tuesday January 5 will meet to consider the question of the removal of the head of the Constitutional Court of Ukraine Oleksandr Tupitsky. This was announced by the representative of the Verkhovna Rada in the KSU Olga Sovgirya on Facebook.
“According to available information, a meeting of judges of the Constitutional Court is scheduled for tomorrow, January 5, at which the issues of the decree of the President of Ukraine on the removal of AN Tupitsky from the post of judge of the Constitutional Court for a period of 2 months, “he wrote.
At the same time, Sovgirya pointed out that the Constitutional Court does not have the authority, on its own initiative, to consider issues and make decisions on the constitutionality of any act (including decrees of the President of Ukraine), in particular at a meeting of judges or in special plenary sessions.
“The question of the constitutionality of this presidential decree can be considered by the Constitutional Court only if a corresponding constitutional submission is submitted to the Court in the manner prescribed by the Constitution and the Law of the Constitutional Court of Ukraine,” said Sovgirya.
He also added that a decision on the constitutionality of any act, including a presidential decree, can only be made in a plenary session.
We will remember that earlier Zelensky removed the head of the KSU from his post. The head of Ukraine dismissed Oleksandr Tupitsky, president of the Constitutional Court, for a period of two months “in the interest of restoring justice.”
Later, the KSU recognized Zelensky’s decree as an abuse of power. By decree on the removal of Tupitsky, the president exceeded his constitutional powers by interfering in the work of the KSU, it was decided in court.
