In the second round of the mayoral elections, violations continue to be recorded. Many of them may be evidence of vote selling. Not that this is predictable, but lately, scammers have become more active in the city, offering to “make money in elections.” Apparently his offer was in demand.
Observers from the public organization OPORA told what they had to face in the polling stations and what were the reasons for contacting the police. This is reported by the informant with a link to the official website of the organization.
Data at 1:00 p.m. At polling station # 121106, at school # 19 on Vladimir Velikogo Street, a window was found in a voting booth through which you can see who the voter is voting for. It should be noted that elections are held here on the ground floor. The window was sealed with paper after OPORA observers addressed the commission members. But this is not the last violation on this site. A woman was also seen here taking pictures of her ballot. A police officer and the head of the commission were summoned to the scene and asked to remove the photo. After doing this, the woman was released without explanation.
A similar incident took place at Electoral College No. 121113 from school no. 48 Aleksandr Konissky Street. Observers noticed a voter photographing their ballot. They reported this to a police officer. The law enforcement officer checked the man’s phone and found photos of the document. The alleged perpetrator testified before the police on duty.
However, the “photo shoot” of the ballots has become the norm among electoral violators throughout the city. Thus, observers report that in half an hour they noticed photographs in the following polling stations:
- 23 Znamennaya Street, school number 8 (section number 121097)
- Calle Peredovaya, 253, “Center for artistic creativity and aesthetics of students” (site number 121054)
- Vladimir Velikogo street, 13, school number 19 (site number 121106) – two cases of photographic recording
- Berezinskaya Street, UVK No. 139 (section No. 121251)
- Berezinskaya Street, 29, UVK # 138 (section # 121238)
- Lipovaya Street, 12, DK “Yuzhny” (parcel number 121445)
- Avenida Mira, 51A, UVK No. 147 (section No. 121245)
On Berezinskaya Street, in UVK building No. 139 at polling station No. 121251, the voter tore up the ballot and threw it into the ballot box. At the same time, the head of the commission refused to call the police, arguing that the offender, most likely, had already left the premises.
At polling station No. 121408 on Krasnoselskaya Street, a member of the commission, in the presence of other members and observers, signed a protocol with the results of the vote around 10:20 am. The OPORA observer called the police. The investigation of the incident is ongoing. According to the article of the penal code, he faces from 2 to 6 years in prison with the deprivation of the right to hold certain positions or carry out certain activities for 5 years.
Data at 5:00 p.m. At polling station No. 121306 on Mostovaya Street (UVK No. 9), the observer noted that not all ballots were distributed to commission members in the morning session. Some stayed in the box next to the head of the electoral commission. After a while, the box was covered with a jacket. And then the observer noticed that the head of the commission took the ballots from the polls and distributed them to the members of the commission.
On Shevchenko Street, at polling station no. 120767 (UVK # 20), observers saw a man photographing a ballot in the voting booth. After the comment, the man quickly removed the photo and left. Similar incidents occurred at polling stations No. 121453 (Health Street, 45A) and No. 121432 (Monitor Street, 3).
Voters were most radical at polling station number 121276 on Kalnyshevsky Avenue in the Palace of Metallurgists. There, a man photographed the ballot. There was a girl with him. When the commission members reprimanded him, she tore up the ballot and threw the pieces away. The man got away.
At polling station number 121245, a man was suspected of photographing his ballot. Police were called to the scene, but while driving, the alleged intruder deleted the photo from the phone. However, the police found three passports with different names on it.
It can not be called a significant violation, but it is worth paying attention. At the 121327 electoral college in Altai, a man received a ballot after he showed a picture of his identification card on his phone instead of a passport. The observer made a comment to the members of the commission. The man had to go home to get his passport, and only after showing it was the voter allowed to cast the ballot.
Data at 20:00. On November 22, OPORA observers recorded 30 cases of ballot photographs in the voting booths by voters in Dnipro and another 1 in Nikopol.
From 5:00 p.m. to 8:00 p.m., these cases were registered in the following sections: No. 121337 (Rabochaya street), No. 121276 – 2 cases (Petra Kalnyshevsky avenue, 27), No. 121470 (Kosmonavtov street, 12), No. 121199 (Getman Petra Doroshenko Street, 3), No. 121258 (Voronezhskaya Street, 67), No. 121306 (Mostovaya Street, 3), No. 121134 (Kombriga Petrov Street, 17). All these violations were recorded by observers.
At polling station number 121276, a woman was photographing the ballot. The head of the precinct electoral commission took the completed ballot and the police officer present said that it was returned to the commission members for “cancellation.”
At polling station number 121258, members of the commission found a man who was photographing the ballot. However, he managed to finish drawing one more “cross”. Therefore, your vote will be invalidated.
Data at 10:00 p.m. At polling station No. 121127 on Calle Topolina, 37, the observer from OPORA during the vote count found that there were 2 control sheets in a large stationary ballot box. The first members of the supervisory commission entered the polls at 7:50, before the start of the voting, and the second, after the end of the demonstration of will. Although it also indicates the time of 7:50. The decision to recognize the ballots in this ballot box as valid must be made by the electoral commission by voting.
Data at 23:30. At approximately 10:00 p.m. on November 22, OPORA observers at polling station No. 121245 received a protocol for counting the votes, which indicated the date of tomorrow, November 23. 566 of the 2,086 registered voters voted in this precinct. 16 votes were declared invalid.
Data at 00:50. At the polling station number 121276 on Petr Kalnyshevsky Avenue, earlier the head of the commission took it from the woman who was photographing his ballot. But he didn’t put it in the urn or turn it off. The OPORA observer called the police, because of this, the commission members voted to remove the observer from the meeting. While the observer awaited the expulsion order, he was physically prevented from filming the video and the law enforcement officers who arrived at the scene did not open the doors. The police were only allowed to enter the police station after the arrival of the second squad. The police officers also discovered that the members of the commission had incorrectly drafted the documents on the removal of the observer from OPORA, since instead of the order he was given a copy of the protocol.
WHAT CAN’T BE DONE
- voting in Ukraine is secret. Control of the content of voter expression, determination and disclosure of a specific voter by any means is prohibited (part 1, article 16 of the Election Code of Ukraine)
- the voter fills out the ballot in the secret voting booth. During the filling, the presence of strangers is prohibited, as well as the recording of photos and videos in any way (part 5 of article 248 of the Electoral Code of Ukraine)
- If a voter is unable to fill out the ballot on their own, they have the right to use the help of another voter, but not a member of the electoral commission, candidate for deputy, candidate for village office, settlement, city mayor, proxy candidate, authorized party representative, official observer. It is imperative to notify the incumbent or other member of the electoral commission about this.
- not a single ballot can remain in the safe. By transferring the ballots from the head to the members of the electoral commission, who, in turn, will deliver them to the voters. The commission signs the declarations and guarantees the security of the ballots.
It should be noted that taking photographs of the ballots is not a separate crime. But it can be used as confirmation of a vote bribe and as a pretext for police checks.
