The Verkhovna Rada of Ukraine made changes to the Budget Code-2021, which led to a legal conflict with excise taxes on fuel for local budgets.

One amendment provides for the retention of 13.44% of the special fuel tax in the general funds of the local government budgets for 1 year as a temporary measure, and the second, permanently. At the same time, the Second Amendment does not remove this from state budget revenue.
Without this law, the parliament cannot approve the state budget for 2021.
In particular, the parliament supported the amendment of the People’s Deputy of the “Voice” Galina Vasilchenko on the return to the local government of a part of the excise tax on fuel.
The rule states that in 2021, 13.44% of the special tax on Ukrainian and imported fuel will be automatically credited to the general fund of local government budgets.
“Establish that in 2021, as an exception to the provisions of paragraphs 1 and 2 of the third part of article 29 of this Code, 13.44 percent of the special tax on the total produced in Ukraine and 13.44 percent of the excise duty on the product imported into the customs territory of Ukraine in its entirety, determined by the Cabinet of Ministers of Ukraine, are automatically credited to the general fund of the local government budgets, “says the amendment.
At the same time, another amendment provides for special tax revenue in the general fund of the state budget. Therefore, a break in the Rada has now been announced. During this time, the finance committee will prepare budget changes and technical amendments to the Budget Code.

The Rada also supported the amendment on redistribution of 40% of the funds that come from the Road Fund to the regional budgets, for the construction of municipal and local roads. The corresponding amendment was voted 236 popular deputies with the 226 votes required.

We offer 40% of these funds, which will go to the regions, to the localities, to be used exclusively for the construction of municipal and local roads. What else does the document provide?
The bill, in particular, defines the details of the provision of state guarantees and the management of state securities. Compared with the editorial board of the first reading, the committee supported the exclusion of the rule on the right of the Ministry of Finance to carry out operations with securities in excess of the volume determined by the state budget.
Among other things, the bill also allows the Treasury to raise funds from the Treasury Single Account (TSA) to fill temporary cash gaps in the general fund of the state budget.
It is envisaged that, not through legislative regulation, but in separate government decisions, issues related to budget revenues and expenditures, public debt and public securities will be determined.
In addition, it is planned to grant the right to lease state and communal property without conducting an auction if the tenant is going to provide services to combat and counteract the spread of the coronavirus.
What the 2021 budget offers

The second reading bill was approved by the Council of Ministers on November 26. The document was voted almost unanimously. The only one who abstained was the head of the Ministry of Health, Maxim Stepanov. The increase in doctors’ salaries was eliminated from the budget, so the official objected.
We remind you that on November 5, the Verkhovna Rada passed the country’s budget bill at first reading by 275 votes. The majority of those who supported the bill are “servants of the people” (209 votes). At the same time, OLSZ, “European Solidarity” and “Golos” did not support the document.
