Defense acquisitions law entered into force

The law creates prerequisites for the development of a competitive environment in the field of defense procurement, improving the quality of goods, works and services for defense purposes for defense needs.

In Ukraine, since the new year, the law on defense procurement came into force, which increased the mechanisms to protect the interests of the domestic manufacturer.

The document provides for the expansion of the scope of the Defense Acquisitions Law in terms of extending its effect to the acquisition of goods, works and services necessary to fulfill the tasks of repelling armed aggression and preventing threats to the security of the State, the Ukraine’s independence, its territorial integrity and inviolability, combat terrorism, eliminate circumstances, leading to the need to establish a state of emergency.

In addition, the bill strengthens the mechanisms to protect the interests of national producers and the national economy as a whole.

It also provides an opportunity exclusively for domestic producers to increase the maximum allowable level of profitability from the execution of contracts in procurement without the use of competitive procedures.

Furthermore, the bill provides for a change in the procedure for appealing recruitment procedures carried out during martial law.

It is observed that the document creates legal and economic prerequisites for the development of a competitive environment in the field of defense procurement, improving the quality of goods, works and services for defense purposes for defense needs. It also complies with the basic requirements of EU legislation at the level of fundamental principles and procurement principles.

Earlier it was reported that Zelensky signed a decree on high technologies in the field of defense, which enters into force the corresponding decision of the NSDC, which involves the transition of Ukraine to an innovative development model in the field of defense.
