The Court of Justice of the European Union ruled that the Council of the EU, when it placed the former prime minister of Ukraine on the sanctions list in March 2019, made a mistake in its assessment.
On December 16, the Court of the European Union declared illegal the EU Council’s decision to extend sanctions against the Prime Minister of Ukraine during the time of fugitive President Viktor Yanukovych – Mykola Azarov.
The decision was posted on the court’s website.
The document says that the former prime minister’s lawyers appealed the extension of sanctions against Yanukovych and his entourage in March 2019. The court ruled that the EU Council did not verify whether the Ukrainian court’s decision, on the basis of which sanctions were extended, it was taken taking into account the rights to defense and effective legal support.
According to the text of the document, the EU Council made a mistake in its assessment when it decided to keep Azarov on the list.
“In these circumstances, the contested acts must be annulled to the extent that they relate to the applicant ”, says the text.
The court also ordered the Council of the EU to pay court costs.
The EU sanctions against Azarov, as well as former Minister of Energy and Coal Industry Eduard Stavitsky, were lifted on March 6, 2020. At the same time, they extended the restrictions against Yanukovych himself and nine others. persons responsible for the abuse of power that caused the loss of public funds of Ukraine.
