Volodymyr Zelenskyy signed a law that the parliament approved on December 15
The signed law eliminates the legislative gaps that arose in relation to the decision of the Constitutional Court of October 27.
President Volodymyr Zelenskyy signed a law on the resumption of the full work of the National Anti-Corruption Agency (NAPK). This was reported by the press service of the head of state on Friday, December 25.
“The implementation of the provisions of the law will help to reduce the level of corruption in Ukraine, restore the functioning of the institutional mechanism to prevent corruption, contribute to the restoration of the proper activities of the NAPC and the fulfillment of Ukraine’s international obligations in the field of prevention and fight against corruption, further translating its European and Euro-Atlantic aspirations, as well as strengthening authority in the international arena “, the message says.
It is emphasized that this document eliminates the legislative loopholes that arose in relation to the decision of the Constitutional Court of October 27 on the recognition of certain provisions of the Law of Ukraine on the Prevention of Corruption as unconstitutional, and ensures the full functioning of the NACP. The law takes effect the day after its publication.
It is also reported that the law establishes additional characteristics of the exercise of the powers of the NACP in relation to judges, judges of the Constitutional Court, in order to ensure compliance with the guarantees of independence of these people. This approach will take into account the decision of the Constitutional Court of October 27 and, at the same time, will preserve the effectiveness and proportionality of the institutional mechanism for the prevention of corruption.
The document also provides 24-hour open access to the Unified State Registry of Declarations of Authorized Persons to Perform the Functions of the State or Local Autonomous Government.
In addition, the law establishes the specificities of carrying out complete verifications of the statements and monitoring the way of life of the judges, ensuring legal regulation in matters of responsibility for corruption and crimes related to corruption.
We will recall, on December 15, that the Verkhovna Rada adopted a bill on resuming the full work of the NAPK. 300 deputies voted.
On October 27, at the request of 48 popular deputies, the Constitutional Court declared certain provisions of the anti-corruption legislation unconstitutional. The decision of the Constitutional Court means the abolition of the electronic declaration, the abolition of the powers of the National Agency for the Prevention of Corruption for a complete control and monitoring of the way of life of officials, the decriminalization of inaccurate declaration.
On the night of October 29-30, Zelensky presented a bill to the Verkhovna Rada, which proposed ending the powers of the Constitutional Court judges and recognizing their decision to declare “null and void.”
