The presidential representative in Crimea Anton Korinevich believes that the International Criminal Court will not incriminate any case against the Ukrainian side. Ukraine has independently and effectively investigated the crimes committed by its military during the Donbas conflict.

As an example, he cites the case of convicted fighters of the special company “Tornado”, which was investigated by Ukrainian law enforcement officers.

“Therefore, I think these will be cases of flagrant violations by the Russian Federation and the separatists. Why? Because the Ukrainian justice cannot reach these people,” he said.

His predecessor in this position, lawyer Boris Babiy, also believes that there will be no cases against the Ukrainian side, but there are significant loopholes in Ukrainian law that could theoretically create problems in international courts.

In addition to ratifying the statute, it is urgently necessary to amend the Penal Code. In particular, to introduce liability for military aggression and crimes against humanity, as well as to regulate the rules for the treatment of prisoners of war, Babin said.

“The question is whether the Ukrainian fighters, the security officers, the representatives of the Armed Forces of Ukraine, the officers carried out the crimes described in the Rome Statute. This will not be decided by the Basmanny Tribunal in Moscow, but by the Tribunal of The Hague, and as an international lawyer, I am 98% calm on this occasion, because I do not see the corpus delicti in your (representatives of Ukraine, – ed..) shares “, – noted.
