The prosecutor of the International Criminal Court, Fatou Bensouda, has completed the study of the materials and is launching an investigation into the case on the situation in Ukraine after the Russian aggression. Ukraine submitted an application to the ICC six years ago.
This is stated in a statement by Prosecutor Bensouda published on the ICC website.
“The legal criteria for initiating investigations into the situation in Ukraine have been met,” he said.
According to the ICC prosecutor, she has reasonable grounds to believe that, in the context of the situation in Ukraine, a wide range of acts have been committed that constitute war crimes and crimes against humanitysubject to the jurisdiction of the ICC. Bensouda identified three categories:
- crimes committed in the context of hostilities;
- crimes committed during detention;
- crimes committed in Crimea.
“My office has concluded that these crimes, committed by different parties in conflictthey were serious enough to warrant an investigation, “he said.
The prosecutor added that she has the support of the Ukrainian authorities in the next stage of the process and asks for the cooperation of all parties to the conflict.
“As we consider future investigations, I also look forward to a constructive and mutually beneficial dialogue with the government of Ukraine and hopefully the Russian government, which will help us understand the best way to do justice,” Bensouda said.
Please note that a preliminary study of the situation in Ukraine was started on April 24, 2014. The deadline was extended on the basis of another statement by Ukraine in 2015 to include crimes allegedly committed in Ukraine after February 20, 2014.
As a reminder, in late November, the ECHR added the Netherlands’ claim on MH17 to Ukraine’s case against Russia. Such a decision will delay consideration of the case, but will increase Ukraine’s chances.
