The definition of what is a “public place” is not clearly defined in the laws of Ukraine. The only mention of the term is in the law on the use of tobacco products.

Ukraine’s President Volodymyr Zelenskyy passed a law introducing fines for not wearing protective masks in public places. Therefore, it is worth finding out what, in reality, a public place, so as not to be fined for its absence.
What is a “public place”

A public place is a part (parts) of any building, structure that is available or open to the public freely or by invitation, or for a fee, permanently, periodically or from time to time, including entrance fees, as well as passages underground, stadiums.
Public spaces: an updated list
So, public places in Ukraine, according to the law “On measures to prevent and reduce the use of tobacco products and their harmful effects on public health,” include:
- elevators and public telephones;
- premises and territories of health institutions;
- premises and territories of educational institutions;
- playgrounds;
- venues and territories of sports and physical culture and recreational facilities and institutions of physical culture and sports;
- entrances of residential buildings;
- underground passages;
- public transportation used to transport passengers;
- local restaurant facilities;
- premises for cultural facilities;
- local government and local agencies, other government agencies;
- stationary stops equipped for road vehicles.
What is a public place in Ukraine / UNIAN photo?
Public places are also indirectly defined in Article 178 of the Code of Ukraine on administrative offenses:
- streets
- indoor sports facilities,
- squares, parks,
- all types of public transport (including international transport).
The list of public places, according to the website of the Cabinet of Ministers of Ukraine, can be expanded by local authorities.
Given the above, the government recommends wearing a mask on the street, since at any time you can be in an area that falls within the definition of “public place”.
Public places in Kiev: where you cannot be without a mask
In Kiev, the list of public places is determined by the order of the Head of Emergency Response Work of the executive body of the Kiev City Council dated 04.04.2020 No. 12.
What areas are UNIAN public places / photo?
Thus, the term “public place” in the capital includes:
- common areas (streets, squares, boulevards, avenues, lanes, tracks, driveways, paths for pedestrians and bicycles, squares and playgrounds, underground passages, parks, recreational areas, gardens, beaches, cemeteries, other common areas);
- premises of state authorities and local authorities, other state institutions, companies, institutions and organizations (in particular, commercial establishments, provision of services, etc.) of all forms of ownership, hotels and similar accommodation facilities for citizens, hostels, stations train and airports;
- transport (including those operating in the regular special transport mode), public transport stops;
- neighboring territories;
- territories of buildings and structures for the protection of engineering territories;
- territories of companies, institutions, organizations and territories assigned to them in the terms of the contract.
Penalties for being in a public place without a mask
According to the law “Amendments to the Code of Administrative Offenses of Ukraine regarding the Prevention of the Spread of Coronavirus Disease (COVID-19)” No. 1000-IX, citizens without protective masks or respirators in public places ( including transportation) in the face will be fined 170-255 hryvnia.

Not only law enforcement officers will be fined for the absence of face masks, but also epidemic control employees and representatives of local government bodies, because it is the latter who are in charge of monitoring anti-epidemic measures. . The same decision to impose a fine can be appealed within 10 days.
