The constitution grants the head of state the right to intervene in crisis situations in the country. The crisis with the KSU, according to the presidential representative, is one of those situations.

The presidential representative in the Constitutional Court, Fyodor Venislavsky, said that Zelensky has the legal authority to dissolve the Constitutional Court. This is what he said on Wednesday, November 11, in an interview with Radio Liberty.

So Venislavsky recalled the 1997 Constitutional Court decision on the powers of the President of Ukraine, on the basis of which Zelensky, according to him, has the right to dissolve the Constitutional Court.

“In this decision, the Constitutional Court said that the President has the direct right to intervene in crisis situations and act in accordance with the challenges that arise in the State and society in order to guarantee the sovereignty of the State, national security , public order and human rights, “he said. Venislavsky.

The presidential representative believes that the CCU decision, which interrupted part of the anti-corruption activities in Ukraine, is precisely a crisis situation and Zelensky has the right to dissolve this court.

“This is clearly a crisis situation. It is quite obvious that the Constitutional Court acted against the interests of the state and society, thus effectively nullifying its own legitimacy. Therefore, the presidential actions were absolutely appropriate,” Venislavsky said, adding that they showed that the president is a clear supporter of the fight against corruption.

We will recall that previously in the Council of Europe they opposed the dissolution of the KSU. The Venice Commission and GRECO sent a letter to Dmitry Razumkov about Zelensky’s bill on the Constitutional Court.

Before that, the European Parliament supported the resignation of the judges of the Constitutional Court. MEPs issued a statement on the abolition of the article on lies in the CCU’s statements and stated that they support Zelensky’s legislative initiative to restore the integrity of the CCU’s proceedings.

On October 27, at the request of 48 popular deputies, the Constitutional Court declared certain provisions of the anti-corruption legislation unconstitutional. The decision of the Constitutional Court means the abolition of the electronic declaration, the abolition of the powers of the National Agency for the Prevention of Corruption to fully control and monitor the way of life of officials, the decriminalization of inaccurate declaration.

On the night of October 29-30, Zelensky presented a bill to the Verkhovna Rada, which proposed ending the powers of the Constitutional Court judges and recognizing their decision to declare “null and void.”
