Ukraine’s Constitutional Court opened a constitutional procedure to find out whether Ukrainian President Volodymyr Zelensky could be fined for violating quarantine rules when he visited a cafe in Khmelnytsky in June.
The Constitutional Court of Ukraine opened a constitutional procedure in response to a request for an official interpretation of the provisions of the Constitution on the possible incorporation of the President of Ukraine into administrative responsibility. The KSU announced this in response to a request from Radio Svoboda.
“By decision of the Third College of Judges of the First Senate of the Constitutional Court of Ukraine dated October 22, 2020 No. 231-3 (I) / 2020, the constitutional processes were opened in this case,” said the Constitutional Court.
On June 3, Ukrainian President Volodymyr Zelenskyy visited one of the cafes in Khmelnytsky during a work trip. Along with him were the head of the President’s Office Andriy Yermak, his deputy Sergei Trofimov, the mayor of Khmelnitsky Alexander Simchishin, the chief sanitary doctor of Ukraine Viktor Lyashko and others.
At the same time, the Cabinet of Ministers allowed visits to those establishments only as of June 5. Until this date, catering establishments could only serve customers on summer grounds or take-out jobs.
The Interior Ministry reported that in relation to officials who drank coffee in a cafe in Khmelnytsky, despite quarantine restrictions, they drew up administrative protocols.
On June 19, the court fined all Zelensky’s comrades 17 thousand hryvnyas, at the same time, no decision was made on the head of state. Judge Andriy Misinkevich appealed to the Supreme Court to clarify whether the head of state could be brought to administrative responsibility, because according to the Constitution of Ukraine, the president is inviolable. The Supreme Court, in turn, decided to take this issue to the CCU.
Zelensky himself stated that he intends to pay the Khmelnytsky café a fine for violating the quarantine, regardless of the court’s decision.
