Venice Commission and GRECO opposed the removal of judges from the Constitutional Court
The Venice Commission and GRECO sent a letter to Dmitry Razumkov about Zelensky’s bill on the Constitutional Court.
The dismissal of the judges of the Constitutional Court is a violation of the Constitution and the principle of separation of powers, which violates the rule of law. This is stated in a joint letter from the Venice Commission and the Group of States against Corruption (GRECO) to Verkhovna Rada spokesman Dmitry Razumkov, published on Saturday, October 31.
According to the organizations, they fully agree on the importance of guaranteeing public trust in the Constitutional Court, because it plays an important role as custodian of the Basic Law and arbiter of the separation of powers.
“Trust does not mean lack of independence. On the contrary, the Constitutional Court can enjoy the trust of other state institutions and the public only if it is truly independent,” the letter reads.
At the same time, the organizations urge the Ukrainian authorities to consider the adverse, profound and long-term consequences for Ukraine of a hasty decision to remove the judges of the Constitutional Court.
“We urge you to explore alternative ways to ensure that the fight against corruption in accordance with international standards remains a priority for your country,” the message summarized.
We recall that previously the European Parliament supported the resignation of the judges of the Constitutional Court. MEPs issued a statement on the abolition of the article on lies in the CCU statements and stated that they support Zelensky’s legislative initiative to restore the integrity of the CCU proceedings.
Zelensky also spoke about the CCU bill. The President’s draft bill is expected to restore public confidence in the constitutional justice process and resolve the crisis situation caused by the actions of the Constitutional Court.
