The Verkhovna Rada of Ukraine has registered a bill to combat cybercrime. In parliament, they want to legalize the use of electronic evidence and force providers to disclose data about user activities on the Internet.
The corresponding bill No. 4004 was registered in parliament on the first day of September.
Its author was Denis Monastyrsky, a people’s deputy of the Servant of the People party. It had the signatures of the Popular Deputy “For the Future”, “Confianza” and the SN (13 signatories in total).
Therefore, the bill proposes to improve public-private interaction between law enforcement agencies and providers during operational search measures, covert investigation actions (search) and temporary access to information, things and documents.
According to the document, telecommunications providers are obliged to install, on their own, in their networks the necessary technical support for covert investigation actions (search) and access to information about the connection, subscriber, reception and transmission path of services of the Internet, its duration and content.
In addition, the bill will complement the list of procedural sources of evidence with electronic evidence, as well as create a special forfeiture procedure for virtual assets.
The document defines that electronic evidence is information in electronic format with information that can be used as proof of a fact or circumstances established in the course of criminal proceedings. Electronic evidence can include text documents, graphics, plans, photographs, video and sound recordings, etc., virtual assets, websites, text, multimedia and voice messages, metadata, and databases.
The document also points out that now the special confiscation does not cover virtual assets, although it is mainly through virtual markets that are not regulated by law that the legalization (laundering) of the proceeds of crime is carried out. In particular, according to the bill, virtual assets that were the subject of a crime or other socially dangerous act are confiscated, except those that are returned to the owner (legal owner).
We previously wrote that last year, the Security Service of Ukraine neutralized 480 cyberattacks on government agencies and critical infrastructure, and stopped the operation of more than 1000 websites that were used for malicious purposes.
It was also reported that the SBU found a group of hackers and stopped their activities. The hackers’ servers were used for cyberattacks against government authorities and banks.
